At Disney racecar attraction, Lamborghini crashes, kills 1

A Lamborghini that was part of an exotic car racing attraction at Walt Disney World crashed into a guardrail, killing a passenger and injuring the driver on Sunday, police said.

The attraction lets racecar fans be drivers or passengers in luxurious cars such as Lamborghinis, Porsches or Ferraris.

the average driver...if placed behind the wheel of a such a race car...would be a danger to himself and others

The article says that it wasn’t known if a customer or one of Disney’s professional drivers was driving.

They are thinking that they are not liable since they didn't operate the track.

The track is operated by Petty Holdings, which has other Exotic Driving Experience attractions at speedways in Atlanta, Daytona Beach, New Jersey, Kansas, New Hampshire and Texas.

I think if the company (Disney) took someone's money in exchange for a service, and something bad happened during this service, they won't be able to wiggle out all that easily. The company would have to demonstrate that they performed all the reasonable and expected steps to ensure safety of their customers. It would be trivial for the opponent to show that giving random people control over powerful cars with unique control characteristics simply cannot end well. It does not matter who operated the track, as long as Disney knew about it and allowed its operation.

Even if Disney had liability, they would have an indemnity clause that would require the vendor to indemnify Disney for any and all liability resultant from the vendor’s operation.

So they sue Disney and Disney just tells the vendor to pay their attorney fees and any award.

They’ll go after the deepest pockets too. In this case likely the sponsor as well as the vendor. Did Disney sponsor a vendor/venue who’s safety precautions might have lacked seriously enough to cause death? It goes on and on.

Indemnity clause. No matter whose fault it is, the vendor will pay the award. It’s part and parcel getting an operating license with a company like Disney.

Pretty sweet vendor contract if it holds. But I imagine the settlements will still be enormous regardless of who’s pockets it comes from.

BTW, the vehicle looks like the passenger side got harpooned by the guardrail.

The OS article states that the deceased passenger was an employee of Petty Driving Experience, and the driver was the customer (24 y/o).

I ride motorcycles. I have been riding since 18 with no incidents, thank God. I have rented dozens of bikes and ridden all over the world in all types of terrain. It never ceases to amaze me that an old middle age retiree will go out and buy the biggest, fastest, heaviest bike as their first bike. It is a deadly mistake. One easily made in a sports car that can put out 800hp driven by an inexperienced driver.
