The only good news out of this catastrophe is his BUSH connection with “JEB” should hurt the Bush clan’s attempt to put another one of those idiots in the White House.

Exactly! Obamacare is going to collapse simply because people aren't going to pay high premiums and get nothing in return.

Millennials are not going to be insurance.

I think thats why Scalia made the SCOTUSCare comment, and I think it validates my point.

Given that he knows better than anyone not on the Court what Roberts’ underlying motivations are, saying that was a direct shot at the “this is YOUR mess, we won’t be responsible for what it does” mentality that I see pretty clearly in Roberts’ opinion.

Chances are Roberts’ beliefs on this will be bourne out, IMHO. When the thing collapses, SCOTUS can absolve itself by saying “look, we took Congress and the President at their word that their motivations were pure”

I DON’T think Obama blackmailed him BECAUSE I have NO proof of that. However, that doesn’t mean there isn’t any proof of that somewhere and that it won’t ever be presented as evidence against either or BOTH of them.

But what if the intentions were and are to collapse the existing US health care system to pave the way for full government takeover and national health care? Then Roberts has just facilitated the grand socialist plan.

I really don’t think blackmails at work here.

If it was, Roberts could have voted with Scalia and the subsidies would have still survived on a 5-4 majority vote. In fact if he was being blackmailed thats how he should have voted; there was no need for a 6-3 vote and he would have partially restored the credibility lost with the earlier decision.

Here’s what I think is at work here, which may be worse than blackmail: Roberts may have a greater affinity and loyalty to the Court than the Constitution. There seems to be a big theme in his rulings and public statements thus far that he’s concerned that the Court is seen as too partisan. Which undermines it’s institutional credibility.

So he refuses to let it be the punching bag on the big issues. It can’t be seen as the one that tore down Obama’s signature program. If/when Obama’s signature program collapses it can’t be seen as the one that pushed it over the cliff.

In fact, as I said in the discussions yesterday, I think Roberts may have very well joined the majority so that, as Chief Justice, he could appoint himself to write the majority opinion and seed it with those very ideas.

I think the only reason the vote was 6-3 is that Kennedy is giving Roberts cover here in exchange for a 6-3 vote on gay marriage. I’m betting that majority vote will be the same as Scotuscare. Kennedy will not have to take the heat for being the deciding vote if Roberts votes with him.

Yes, “we” will see it that way.

But from a legal perspective the Courts official opinion will be that it trusted that the other branches motivations were in good faith and it wasn’t the Court’s role to question that. The legal term for this is “regular order” I believe and it’s a well established and accepted concept.
