NC man fights HOA order to remove Confederate-style flag

CARY, NC (WNCN) — A Cary man is fighting an order from his homeowner’s association to remove a Confederate-style flag that’s flying on his front porch.

Frank Bray says he purchased the flag, which features elements of the North Carolina state flag as well as the Confederate battle flag’s stars and bars, in reaction to recent news events, he believes, unfairly depicts the flag as a symbol of racism. It’s flying outside his home in the Carpenter Village neighborhood.

“I’m proud of where I’m from,” Bray said. “There’s no malice or ill-will behind it.”

But in a letter from Omega Association Management, Bray is notified that his flag represents a violation of HOA rules.

“Please be aware that this type of flag is not permitted in the community,” the letter reads. It goes on to say, “We have received several complaints regarding the offensive nature of your flag, as well as concerns it may hinder the sale of homes in the community.”

My dad’s down there, grew up in Grand Rapids, MI (that’s why he’s down there, LOL) Took him a while to get used to the southern pace. He loves it now, he’s learned to relax. He was always a bit high strung when I was a kid. Doubtless I contributed to that. Yankees do change if they marry a southern girl. Which my dad did.

The guy is going to lose this one -- and badly.

HOAs have a lot of authority under the laws of most states, and the residents who live under this authority have nothing to complain about -- because when they bought their homes they had to sign their titles acknowledging all of the rules and regulations of the HOA.

There's nothing wrong with taking a principled stand, but it's idiotic if you are on the wrong side of the legalities of it.

If the HOA allows flags, any kind of flag, they will lose.

There's nothing wrong with taking a principled stand, but it's idiotic if you are on the wrong side of the legalities of it.

Anything can be fought, and better than fighting in court is fighting in the media. In the age of social media, you can win even if you are on the "wrong side".

HOAs are required by law to allow residents to fly U.S. flags. Other than that, they have all the authority in the world to keep anyone from flying their flags.

If the HOA allows flags, any kind of flag, they will lose.

Even if they do allow flags, they won't necessarily lose. HOAs usually have a lot of discretion to make decisions on a case-by-case basis.

I think a lot of this is pointless. The idea of a principled citizen flying a Confederate flag -- while he voluntarily lives in an HOA with a totalitarian "government" -- is comical.

The Courts have ruled flags as freedom of speech. The HOA will not away with allowing one without allowing this one.

We lived in Cary for 6 years and it is a Containment Area for Relocated Yankees! Especially those from New York and New Jersey...basically the pushy ones.

Can you cite me a court case where a court ruled in favor of a homeowner against an HOA management in a flag dispute that involved something other than a U.S. flag?
