IMO the kids hit a squall and wicked seas,lost power tried to restart got swamped and washed over board.

Anytime I went out with anyone I wanted to know where my life jacket was and had it on or near by,or didn’t go.

Just a guess, but probably in a backpack in the cabin. . . turned off to preserve the battery. The boys were quite a ways out at sea, more than 100 nautical miles, which takes quite a bit of time. That quite a ways away from any cell towers. The boat most likely had it's own navigation system, so I suspect the iPhone would have been turned off to conserve battery time. I doubt there will be anything probative on it.
Nope. The looks like an iPhone 5S or perhaps a 6. The FBI can only unlock an iPhone 5C. . . Not any other models after the iPhone 5C. They've tried on later models and bounced.

The boat was found once by the Coast Guard, then lost and then found again.

What part of "The father, the owner, has the iPhone's passcode" do you fail to grasp? Unlocking the device is not an issue. . . Getting the data off of a very damaged unlockable device with the owner's permission who has the device's passcode is nowhere in the same zip code as unlocking a completely working secure device without a known passcode. Not even in the same state.
As for your statistics on the H1B visa, Apple has 60,000 employees in the US. H1B visas have to be renewed every year. 2.5% of Apple's workforce in the USA is from H1B visa users. There are tech companies with more than 25% of their workforce employees H1B workers. . . And there are companies in the Hospitality industry with upwards of 80%. Apple's Tech support in the US is located in the United States. Can you say the same of Dell or HP? AT&T? Google? FaceBook?
