The legalization of medical marijuana comes with a big issue for Oklahoma's gun owners. If you want to get medical marijuana, you can't own or buy a gun.
Federal law prohibits any person who is an "unlawful user of or addicted to any controlled substance" from possessing firearms or ammunition. The law covers everything from owning, shipping, transporting or receiving any firearms or ammunition.
There are no exceptions in the law for medical marijuana users.
Some gun shop owners we talked to are a little concerned.

"That was my initial reaction - my gosh, we might lose some business," said Austin Warfield, owner of C.O.P.S. Gun Shop.
"We might lose some gun sales because if someone has a medical marijuana card, they won't be able to purchase a gun."
Warfield said they will be making sure any transaction in their store is legal.
"Well, they fill out the state or federal form 4473 background check," he said. "On that form is a question, are you addicted to marijuana or any other drugs."
Question 11.e. on that form asks:
Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Warning: The use or possession of marijuana remains unlawful under Federal law regardless of whether it has been legalized or decriminalized for medicinal or recreational purposes in the state where you reside.
The ATF recommends current gun owners make a plan about what they are going to do with their weapons before getting a medical marijuana license.
What about medical Prozac users?

Yep. Or any of the dozens of mind-altering substances prescribed to make broken brains “work” again.
But pot is sold over the counter in Colorado...so as a practical matter, theres no way for the Feds to know that someone uses pot unless they admit to doing so on the Form 4473.
Not that someone would lie under such circumstances. That would be wrong. :-)

Neither are drunks with guns, but they’re all over.
In Hawaii they already matched “medical” marijuana card holders with the firearms database and started the ball rolling on seizing weapons from any card holder. No Supreme Court decision will overturn this. The only hope for dopers is to have marijuana legalized at the federal level and also at the state level, as I suspect some states will still try to keep the stuff illegal.
What is the issue here? You already have to say No to drugs to buy a gun therefore there should be no pot users with guns. Any with them should be charged with federal possession. Note: I’m all for guns but equally opposed to pot.
It only applies in Colorado to those with a medical marijuana card, which can still be obtained. Growers grow legally “for” people who give them their cards. Those growers sell to others to, of course. It’s called the grey market.
On the application for CCP in Colorado is a question asking if you are “addicted” or if you “abuse” any drugs.
Guess what everyone answers.
The only ones they can deny are the ones with the med cards.

DOH! I take Cosyntex for psoriatic arthritis. Will I be next? Inquiring minds want to know. Plus last year I had neck surgery in Nov. Does that disqualify me? But seriously, I suppose if you’re okay with the state but are violating federal law, checking the yes on 4473 tosses you out right? Haven’t done one in a while so not sure what’s on it now.
