Prenups are probably a net destroyer of the institution of marriage. (As are over-liberal laws in the other direction.)

Many years ago, in a time far far away from now, women could be economic prisoners, men knew that and a deal was made to support one another. Divorce was hard on the women if they were left and alimony / child support was the response. Mostly good and proper. Getting a divorce was hard as it should be.

Women became empowered, they no longer needed a man. If they pleased they could leave. If they had grounds for divorce the man could be punished leaving us where we are today.

Neither having women as economic prisoners in a bad marriage to a man who is simply no good nor the situation of today are any good at all. Marriage can be hard and not entered into lightly. It is a shame most marrying is done by hot blooded youngsters mistaking lust for love then having to work out an agreement and life or not after the lust is gone or transferred.

I think the principle should be simple and straightforward.

If your infidelity caused the divorce, you are judged to be at fault, and you get NADA. Be you male or female.

What could be more fair than that?

Like I said before, yes, if the 2 parties are significantly different in wealth status. Otherwise if one party insists on prenup, the marriage is starting out unnecessarily with consternation.

I have a friend whose son signed a prenup before he got married.

His wife is from a wealthy family that owns a lot of successful businesses. Her father’s corporate attorneys apparently really pushed for this.

He signed it. But my friend is very worried that the mere act of this alone signals the marriage is doomed for failure.

Anybody divorcing somebody and marrying a trophy spouse should definitely have a prenup.

True. But it does make sense later in life, when two people 50 and over with existing kids decide to get married. Even if they live till death do they part, does everything that man accumulated before marrying then go to his new wife’s kids? I

If it’s your 2nd marriage I agree.

Just married the widow of one of my best friends in the world. They married as kids, he made good money as a banker and was frugal. He left her a pretty big stash of marbles, which by all rights should go to their son . . . at least what is not needed to live on. I am a banker also, but had to start over after a divorce 18.5 years ago. I was well along toward building some assets that I wanted to pass along to my sons. He left her in such good shape, she was more than willing to agree to allow me to continue along that plan, and we signed a pre-nup to that effect. It only made sense to me. And we both still work. I am 63. They don't come any better than my new wife. She is an awesome lady!! I am blessed indeed!!

I agree. Also if one spouse physically abuses the other, regardless of sex, that spouse should not get any form of alimony.

Yeah, I’ve never been a fan of the blind 50/50 split, especially if the couple have only been married a year or so. It does give unfair advantage to the gold digger, who should get nothing. But it’s hard to codify anything else into law.

I think prenups make sense if you are a male with considerable premarital assets. I’m pretty sure President Trump has had prenups or his multiple divorces would have cost him a lot more.

That said, when I got married neither of us had a bean so we didn’t bother with a prenup. Our first marital residence was a studio apartment in a bad part of Riverside where it was not uncommon to hear gunshots at night. Years later, we’re still happily married. Starting out poor didn’t destroy our marriage; it strengthened it by making us more grateful for what we have, including each other.
