In an apparent move to avoid the crowd of reporters and citizens outside the courthouse, the jurors are taken out of court through an underground parking garage instead of their usual exit on the sidewalk. Beth Karas and I are standing outside the garage when the two sheriff's vans pull out. I can see the Teamster seated in the front passenger seat of the first van. A photographer from the Modesto Bee is standing with us and he begins taking photos. The court officer driving the first van slams on the brakes and leaps out of the vehicle. He stomps over to the photographer, Al Golub, while shouting, "Did you take a picture?" He stammers, "I did." The officer orders him to hand over the disc from his camera. He offers to delete the image, but the officer snaps, "I don't have time, buddy." He grabs the disc and gets back in the van. The van pulls away, brakes sqealing. The second van follows. In the front seat, Strawberry Shortcake is roaring with laughter. —Harriet Ryan

False alarm. Delucchi announces that "the jury has been asked to be excused for the night. They'll be back Monday morning 8 o'clock." No verdict this week. —Harriet Ryan

Just minutes ago, the courtroom was atwitter because Stanislaus County District Attorney James Brazelton took a seat in the courtroom. Does it mean something? Is a verdict near? Those questions quickly fade as Brazelton walks out of the courtroom. The bailiff, who has been walking in and out of the judge's chambers, tries to reassure nosy reporters that he's just "doing some housekeeping." "Because I'm running around doesn't mean anything happens," the bailiff says. "It doesn't mean nothing's happening," someone shouts back. —Harriet Ryan....
Jurors Deciding Scott Peterson's Fate Get Back At It Today
REDWOOD CITY, Calif. -- Some legal observers say the fact there was no quick sentence recommendation is a good sign for Scott Peterson.
Jurors return to work Monday in Redwood City, Calif., as they decide if Peterson should get the death penalty for murdering his pregnant wife, Laci.
The jury took the weekend off after deliberating for 8½ hours last week. The panel will remain sequestered until it reaches a unanimous agreement.
If jurors can't agree on a sentence, prosecutors must choose whether to retry the penalty phase or accept a default sentence of life in prison.
Even if Peterson gets the death penalty, he's more likely to die in prison from natural causes, suicide or murder......

JURY CONFLICTED ON PETERSON'S FATE
December 11, 2004 -- REDWOOD CITY, Calif. — Scott Peterson's jury failed to reach a decision yesterday after deliberating all day.
The jury will be sequestered for the weekend and resume deliberations Monday on whether he should get a lethal injection for killing his wife, Laci, and their unborn son, Conner.
For the first time since the trial began, Peterson failed to show up in court. But had the jury reached a verdict, he would have been brought in to hear it.
The jury has already spent more time in deliberations than it did before convicting him Nov. 12 of the first-degree murder of Laci and the second-degree murder of Conner.
Legal analysts interpreted this as a sign jurors may not be unanimous on Peterson's penalty. .....

The jury pondering the fate of Scott Peterson finished its second day of deliberations without reaching a verdict Friday, following Thursday's emotional and skillful closing arguments by prosecutor Dave Harris and defense lawyer Mark Geragos.
Most legal observers praised Harris for making a compelling argument for execution without appearing bloodthirsty. He called Peterson a ``monster'' and the ``worst of the worst.'' And he provided one of the trial's most quotable moments: ``Laci was an anchor around his neck, so he put one around hers.''
But it wasn't just his words. Unlike William Jennings Bryan or Clarence Darrow -- or even Perry Mason -- lawyers today don't have to rely only on fiery oration to move a jury.......

Peterson Jury Quits For Weekend
(CBS/AP) The jury in the Scott Peterson double-murder trial had not asked any questions of Judge Alfred A. Delucchi during its first full day of deliberations before resting for the weekend.
Deliberations are expected to begin again on Monday.
CBS's Teri Okita reports that the jury could seal the fate of the former fertilizer salesman any day now. It's been almost a month since Peterson was convicted, but just days since the jury heard dramatic closing arguments: One pleading for Peterson's life, the other calling for his execution.
In a scene fitting for a TV drama, Peterson's lawyer begged jurors not to sentence his client to death for killing his pregnant wife.

Peterson Penalty Deliberations to Resume
REDWOOD CITY, Calif. Dec 12, 2004 — The fact that jurors did not immediately return a sentence recommendation for Scott Peterson bodes well for the man convicted of murdering his wife and her fetus, legal observers said.
Jurors resume deliberations Monday on whether Peterson should be sentenced to death or life in prison. They took the weekend off following 8 1/2 hours of deliberations ending Friday afternoon.
"It was a good sign for Peterson that they didn't come back immediately," said Loyola Law School professor Laurie Levenson. "It makes a lot of sense to me that frankly they wanted to take the weekend … Because I think in the amount of time they've deliberated, about the only thing they've been able to do is hear each other out."
The jurors will remain sequestered in a hotel until they reach a unanimous agreement on a punishment. The judge will formally sentence Peterson on Feb. 25........

"I give this jury a lot of credit," said Loyola Law School professor Laurie Levenson. "They have a big decision to make and they weren't going to rush into it."
Jurors ended their deliberations Friday afternoon, asking the judge if they could take a weekend break before resuming their debate Monday over whether Peterson should receive a death sentence or be sentenced to life in prison without parole.

I'd almost rather he gets LWOP.

I'm kinda hoping for LWOP. The sentence is less vulnerable to appeals and the prisoner is more vulnerable to the elements.

I am "sort of" hoping for DP.

The LWOP sentence is less vunerable
and for that reason alone, I won't
be disappionted if he gets LWOP.
