"She chose drugs over us". Her sister was sick of cancer, we didn't see a penny of Anna trying to help her family ever".

So much money and not a penny to a sick sister? I feel sorry for her tragedies but not for her cold heart!

Now that the latest is that Anna Nicole left everything to her son and apparently did not change her will after he died, it will pass to his next of kin--which I suppose is his grandmother Virgie.

I doubt it; I think it will go to Anna Nicole's baby daughter. Most state probate statutes allow for inheritance by children born after the decedent made their will. The rationale is that the decedent intended for their child to inherit, even if they didn't get around to changing the will to include the new child.

But then the issue falls back on paternity. I know under Bahama's slender law there is apparently no procedure to challenge paternity--it is whatever the mother states on the birth certificate. But the estate will be probated in the US--California I assume. It will have to force the hand of Stern because I can't imagine a court in California not requiring a paternity test to decide who will be the guardian over this child's estate. At the moment the only uncontestable next of kin under US jurisdiction is Virgie.

You're right, Virgie is next of kin until the baby's paternity can be established. But that doesn't guarantee her or the baby's father (whoever he is) control of the estate. The executor has to be approved by the probate court. Someone who has shown a propensity to self-deal (e.g. Howard Stern) or who is not capable of managing a complex estate (Virgie, probably) might well not be approved. The estate may end up being administered by the public administrator of of the probate court. This will be an interesting one to watch, and I'm enjoying our discussion.

I just asked my mother (she's an attorney) about what would happen to Anna Nicole's estate. After she lectured me about wssting my time being intersted in it in the first place--she told me if the will were probated in Texas the estate would be divided between Daniel's hairs on the paternal and maternal sides. This would mean that half would go to Daniel's father and the other half would be divided between Virgie and Danielynn (if I read the law right a grandparent and a half sibling are considered heirs of co-equal relationship).

Sorry to sound sarcastic, but when people say something doesn't interest them, then they are posting about it I think they are fooling themselves. Look I hate that I am even reading this myself. I hate that I have read about Britney's shaved head. I just mark it up to boredom.

The whole zoo down there is strange. I am wondering what will happen if none of the daddies down there turn out to be the baby's real father.....I never really watched the ANS show except for a short time here & there but when I did I never thought Howard K looked stoned. I really don't care who is what or what is who.....just get that poor baby away from ALL those people. And I wish this would hurry up & get off tv.......Many prayers for that poor baby & the hope she stays safe and finds a loving family. ~P~

Time for THE LIST!!!!!

This case has not been so much about the Tabloid Anna Nicole Smith, but the legal crises surrounding;
The death of a son - about to reach his majority (age 21)of undetermined manner and cause. Could be homicide.
The birth of a daughter - whose paternity and custody is in question - who may also have been born addicted to illegally obtained prescription drugs.
The premature, undetermined death of the infant's mother -could be homicide, suicide or misadventure.
Conspiracy to access a $1.6billion estate and eliminate per stirpes heirs.
Conspiracy by lawyers and foreign government officials to circumvent immigration laws for fraudulent purposes.
Intent to defraud owners of real property and real estate.
Illegal transportation of prescription drugs, by interstate and international waters.
Potential kidnapping of a US citizen.
Creation and presentation of fraudulent documents to avoid parental and custodial rights.
Possible religious bias against a Southern Baptist/Christian upbringing for a child who had a GODMOTHER appointed by her mother, who had a "Baptist" minister perform a "committment ceremony". Will the self-appointed father honor this religious affiliation or circumvent it?

WE SHOULD ALL BE TERRIFIED THAT THESE SAME LAWYERS, GOVERNMENT OFFICIALS AND JUDGES COULD PUT ALL OF US IN JEOPARDY.

A REVIEW OF ALL THE "LEGAL" RULINGS TO DATE SHOULD REMIND US TO NEVER LEAVE OUR AFFAIRS IN THE HANDS OF LAWYERS OR JUDGES.
