Is Obama a Natural Born Citizen?

Obama Crimes

Philip J. Berg, Esq. Files Federal Lawsuit Requesting Obama Be Removed as a Candidate as he does not meet the Qualifications for President

Thursday, 21 August 2008 22:09

For Immediate Release: - 08/21/08

Suit filed 08/21/08, No. 08-cv-4083

Contact information at the end of this press release. Documents filed with the court and a copy of this press release can be downloaded at the end of this press release.

(Lafayette Hill, Pennsylvania – 08/21/08) - Philip J. Berg, Esquire, [Berg is a former Deputy Attorney General of Pennsylvania; former candidate for Governor and U.S. Senate in Democratic Primaries; former Chair of the Democratic Party in Montgomery County; former member of Democratic State Committee; an attorney with offices in Montgomery County, PA and an active practice in Philadelphia, PA, filed a lawsuit in Federal Court today, Berg vs. Obama, Civil Action No. 08-cv-4083, seeking a Declaratory Judgment and an Injunction that Obama does not meet the qualifications to be President of the United States. Berg filed this suit for the best interests of the Democratic Party and the citizens of the United States.

Philip J. Berg, Esquire stated in his lawsuit that Senator Obama:

1. Is not a naturalized citizen; and/or

2. Lost his citizenship when he was adopted in Indonesia; and/or

3. Has dual loyalties because of his citizenship with Kenya and Indonesia.

Berg stated: “I filed this action at this time to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated.

There have been numerous questions raised about Obama’s background with no satisfactory answers. The questions that I have addressed include, but are not limited to:

1. Where was Obama born? Hawaii; an island off of Hawaii; Kenya; Canada; or ?

2. Was he a citizen of Kenya, Indonesia and/or Canada?

3. What was the early childhood of Obama in Hawaii; in Kenya; in Indonesia when he was adopted; and later, back to Hawaii?

4. An explanation as to the various names utilized by Obama that include: Barack Hussein Obama; Barry Soetoro; Barry Obama; Barack Dunham; and Barry Dunham.

5. Illinois Bar Application – Obama fails to acknowledge use of names other than Barack Hussein Obama, a blatant lie.

If Obama can prove U.S. citizenship, we still have the issue of muti-citizenship with responsibilities owed to and allegance to other countries.

Berg continued:

Very interesting. Why does a African American group in Houston Texas make a claim like this about Obama? .........

Same guy. He's a nut. And a lawyer. And a big Hillary supporter.

Regardless of his credentials, I hope this is hugely embarrassing for Obama.

Maybe he'll even have to cough up a genuine birth certificate.

If he has one.

I think he was probably born on US territory, but if he was adopted by an Indonesian that his leftist, Muslim-loving mother married in Indonesia, and he never regularized this, I’d say he’s still a citizen of Indonesia.

Does this mean the fat lady gets to sing at the convention?

If this defeats Barry Soretoe at the DemocRAT convention then that means the Dragon Lady will let him live.

I was frankly surprised to see that Berg is a lawyer. He cannot possibly have been a litigator. The Complaint is such an abomination on so many levels, it is hard to believe a lawyer actually drafted it. In its present form, this case is going nowhere.

I recognize that, but I don't think this is going to cause any superdelegates to waver. A lot of them are lawyers, and they are going to recognize this for what it is -- a rant and nothing more.

That said, there are a lot of interesting issues raised in Berg's Complaint. I would love to see them really investigated by someone competent.

I beg to differ; First, this puts a lot of pressure on Obama to come open and clean on his whole citizenship status. Secondly, even if the chances are slim, the stakes are enormous for the Dem Party, and that will make for some head-scratching.

I can understand the argument (though it's not in accordance with current Supreme Court law) that birth in the US + American Citizen Mom (if under a certain age), isn't enough to make you a citizen.

BUT, IF you are a citizen at Birth, I can't possibly see how being jerked around the world as a kid, voluntarily or involuntarily, by mom, dad, step dad, kidnappers, or whoever, can possibly de-citizenize you.

Imagine that your kid is 100% American. your spouse decides to split when kid is 5, goes to Flyspeckia, marries a Flyspeckian -- your kid's not an American any more?? She can never be President?? I doubt that you would think so.

I sent an email to my brother in Washington, DC yesterday, as soon as I heard about Berg's lawsuit, and received this reply from him last night:

[excerpt]

Actually a friend of mine who works at a wire service called be around 9 telling me "YOU WON'T BELIEVE THIS!" ...

He told me the below [my email] and I told him I've heard rumor of it already ... Then I told him he needs to spend less time with the NYT and more time reading THE SPOTLIGHT ...

Anyway, he said that it is all anyone is talking about at the National Press Club ...

I wrote him back, a bit harshly, saying that the media was ignoring Berg's lawsuit, and that his friend probably meant the Factcheck thing.

He wrote me back today, correcting me.

[excerpt]

No - my friend at the Press Club was talking about the exact same thing you were: The temporary restraining order out of the PA US District Court ...

He said they were trying to figure out if it is something to report or ignore ...

CNN, acknowledging, though dismissing, the question BHO's birth certificate their take, not mine, on how to handle the potential issue ... Though it was still more than anyone else in the MSM has done ... And it also indicates how the story will be spun if it has to be discussed ...

My goal was just to let you know that the MSM is actively concerned they might have to talk about this ...

I consider my brother a reliable source on this. So, on the word of his friend, we have it that -- although the media have been ignoring the Lawsuit story in public, in private it was "all anyone is talking about" at the National Press Club in Washington, DC, last night.

AND that the media folks are worried that circumstances might force them to report on Philip Berg's Lawsuit.

Incidentally, this is the same brother who told me about Shepard Fairey.

Hmmmm! what is going on here!

From Berg’s Lawsuit!

Wayne Madsen, Journalist with Online Journal as a contributing writer and
published an article on June 9, 2008 stating that a research team went to Mombassa, Kenya,
and located a Certificate Registering the birth of Barack Obama, Jr. at a Maternity Hospital,
to his father, a Kenyan citizen and his mother, a U.S. citizen.
At the time of Obama’s birth in 1961, Kenya was a British Colony. There is a
purported Canadian Birth Certificate, posted on the Internet, in the name of Barack Hussein
Obama, Jr.; however, the date of birth is shown as August 23, 1961.

“I can understand the argument (though it’s not in accordance with current Supreme Court law) that birth in the US + American Citizen Mom (if under a certain age), isn’t enough to make you a citizen.”

You misunderstand the entire case. The question is not whether Obama is a citizen, but whether he fulfills the requirement of a “natural born citizen” ie born-on-American-soil. A citizen and a natural born citizen are two different things. I hope that cleared it up some, I know it’s a bit confusing.

According to the folks at Texas Darlin', if Lalo Soetoro legally adopted Barry and gave him Indonesian citizenship when he married Stanley, then Barry lost forever-after his status as "a natural-born citizen of the USA."

After returning from Jakarta to Hawaii, BHO could regain citizenship under INS laws, but it would be as a [re-]"naturalized citizen."

Q.E.D., Barry would be ineligible to run for president.

The folks at Texas Darlin’ don't know the law. No one, including a father, adoptive or not, of a minor child, can renounce a person's American citizenship for him.

Obama travelled to Pakistan in 1981, at the age of 20. It is suspected that he used an Indonesian passport to do so. If this can be established, it would show an acceptance of Indonesian citizenship by Obama as an adult.

Here is an alanysis of the adoption issue:

Obama was legally adopted by Flaky Mom’s Indonesian spouse of the moment. He then became a citizen of Indonesia and was registered as such in Indonesian schools. To my knowledge, his Indonesian citizenship was never renounced.

Irrelevant as to his citizenship. There is only one way to renounce your citizenship. Go to an American embassy or consulate and fill out the specified forms. Obtaining and using a foreign passport does nothing.

Of course, if it turned out that he had used a foreign passport, that may (or may not) disqualify him from serving as President. The decision of disqualification will be made by each American voter as individuals. In the voting booth.
