Berg's Simple Question

Below is a sample of a not untypical response which those of us who have been writing about this case have been receiving. Note particularly the smug condescending tone of the opening insult. The commenter has reluctantly agreed to descend from the rarefied atmosphere of his purported legal expertise to clarify these obtuse issues for us woefully uninformed laymen.

I think it might be helpful here to remind commenters such as the above mentioned that we are all of us laymen. For all of us there are innumerable subjects about which we may know little or nothing. To allow oneself to get puffed up over one's accumulation of knowledge in one particular field of expertise lays one open to questions about one's ignorance in all of those other areas. For most of the genuine experts I have had the pleasure of meeting or corresponding with, they have all seemed to share an easy familiarity with this concept of comparative ignorance. It is simply called humility. But for some, unfortunately, this character trait is noticeably absent. And for those of us who by force of circumstance must deal with these arrogant pomposities we must choose to either try to deflate them or if possible to just ignore them. Read the small sample below and you'll quickly see what I mean.

"Ok, I will try to explain this as simply as I can because it’s obvious that none of you know a thing about how this works: 1) The order filed by Berg requesting certain items regarding Obama’s citizenship is a BLANK ORDER. It’s not signed by the court’s judge (Surrick). It’s common practice for attorneys to draft up orders in their favor so all the judge has to do is sign it if he/she grants the attorney’s wishes. However, the court already DENIED Berg’s first motion back in August [1], and Berg submitted another motion asking Obama and the DNC to submit documents by October 15th. This motion is moot because the judge has NOT signed it and will most likely dismiss it (again) for reasons I explained earlier (Berg lacks legal standing to sue ..."
The now famous Berg v. Obama case to which this commenter refers is a perfect example of this problem. It is by definition a legal issue which calls for a certain degree of legal competence to comprehend the complexities involved. Yet we need not have a law degree to recognize these attacks for what they most certainly are. They are simply rebuttals. Not just professional dissenting opinions, but hot angry and impassioned denials. These respondents are not just interested in refuting the facts of this case; they are seeking to totally discredit and destroy the opposing advocate, whom they repeatedly characterize as an incompetent -- or worse.

However, to this particular layman it seems -- despite the labyrinth of legalise with which the liberal opposition has attempted to obscure the real issue involved here -- that if the Obama supporters are resting their case on their desperate attempts to define Atty. Berg as a 'nutcase' they have little ground to stand on. His resume alone would preclude this assumption. Yet how often have we read this same line of defense -- that Berg and his whole absurd case are inconsequential because he's a nutcase?

Well, to me, this nutcase's simple question -- "If you are a natural born citizen, Mr. Obama, what are you hiding?" is simply overwhelming. And the silence is simply deafening.

Well, Mr. Obama -- What are you hiding?

Great to see this is heating up. If nothing else, it puts doubt in voters minds as to “What is he hiding?”

My biggest concern is the possibility of a constitutional crisis with democrats and RINOs in control of congress. With the way they behaved over the bailout bill I shudder to think what they would do if given the opportunity to “tweak” the constitution.

At this point, I’m not so sure there aren’t plenty on both side of the aisle who would love a chance to make changes to our constitution.

Congress can’t make changes to the Constitution without going thru the amendment process. And any legislation passed is subject to being challenged constitutionally. That’s the way the system works.

Accusing API of colluding with American internet bloggers in an effort to bring down her husband, Mrs Obama said she decided to call API because of what she termed, API’s help to spread rumours created by American bloggers and other racist media outlets in their efforts to damage a black man’s name, saying she hopes African Media was mature enough to be in the front to give unwavering support to her husband, a man Africans should identify themselves with.

When API told her that our online news media was only relaying what the American Bloggers and other media outlets had discovered through their investigations, Mrs Obama was angered and she came out loud with the following: “African press International is supposed to support Africans and African-American view,” and she went to state that, “it is strange that API has chosen to support the racists against my husband. There is no shame in being adopted by a step father. All dirt has been thrown onto my husband’s face and yet he loves this country. My husband and I know that there is no law that will stop him from becoming the president, just because some American white racists are bringing up the issue of my husband’s adoption by His step father. The important thing here is where my husband’s heart is at the moment. I can tell the American people that My husband loves this country and his adoption never changed his love for this country. He was born in Hawaii, yes, and that gives him all the right to be an American citizen even though he was adopted by a foreigner; says Michelle Obama on telefon to API.”

This is a very interesting turn of events. The American man Dr Corsi was recently reported to have been arrested in Kenya because there was fear that he might reveal information on Obama when he wanted to hold a press conference in Nairobi.

The question now is why he was arrested and who ordered his arrest. Was Obama’s hand in this in any way? We will never know the truth but what is clear is that Dr Corsi was seen as a threat while in Kenya.

When API asked Mrs Obama to comment on why Dr Corsi was arrested by the Kenyan government and whether she thought Kenya’s Prime Minister Mr Raila Odinga was involved in Dr Corsi’s arrest, she got irritated and and simply told API not to dig that which will support evil people who are out to stop her husband from getting the presidency.

When asked who she was referring to as the evil people, she stated that she was not going to elaborate much on that but that many conservative white people and even some African Americans were against her husband, but that this group of blacks were simply doing so because of envy.

On Farakhan and his ministry, Mrs Obama told API that it was unfortunate that Mr Farakhan came out the way he did supporting her husband openly before the elections was over. That was not wholehearted support but one that was calculated to convince the American people that my husband will support the growth of muslim faith if he became the president, adding “even if my husband was able to prove that he is not a Muslim, he will not be believed by those who have come out strongly to destroy his chances of being the next President. Do real people expect someone to deny a religion when 80 percent of his relatives are Muslims?; Mrs Obama asked.

Mrs Obama asked API to write a good story about her husband and that will earn API an invitation to the innoguration ceremony when, as she put it , her husband will be installed as the next President of the United States of America next year.

With regard to BHO’s citizenship I offer this information. I attended a Republican Candidate appreciation bar-b-que last night given by Senator Jim Duncan - my Tennessee State Senator.

So I asked Senator Jim Duncan - “Is Obama a Natural Born Citizen of the United States of America?” He said - “I really don’t know.”

I also spoke with Senator Lamar Alexander (who was their supporting Senator Jim Duncan) and asked the same question. Senator Alexander’s answer was - “Yes - he was born in Hawaii and his mother was born in Kansas. At least thats the best information I have.”

This gathering was in Knoxville,Tn October 14,2008 in the city where I live.

Regardless of how much evidence is uncovered and presented, Berg is not going to get this to fly because the judge CAN stop it.
Can you imagine what would happen if there was an official investigation into Senator Obama’s citizenship and his right to be the Democrat's candidate; the Chad Mess in Florida would look like a minor inconvenience. It's to late now to go this route.

No, it just makes him, at the most, a naturalized U.S. citizen, if he recovered his citizenship after being adopted by Lolo Soetero and becoming an Indonesian citizen but also simultaneously losing his U.S. citizenship when his custodial parent, Stanley, married Lolo and became an Indonesian citizen. In either case, he's ineligible to be president.

Not really. There are two way to change the Constitution: 1) Amendment, 2) Constitutional Convention.

Beware #2 if the Conservatives lose too many seats in the House and Senate.

Obama’s grandmother isn’t a racist, and she knows Obama was born in Kenya. Others know it too, but Obama was too young to remember. Even though he is the one, he has limitations. I say we forgive him his mistake, and wish him well as he moves on to a different career goal, one that is legal for him to pursue.

You wrote that the amendment process is the ONLY way we can change our constitution.

I pointed out your error. A Constitutional Convention is the second way.

Whether I believe one can be held or not is immaterial.

Fascinating. Are we to believe from these comments that there was any doubt Farakhan would endorse 0bama when he supported his bid for the Senate? Is she now trying to *step back* from the couples' ties to Farakhan and his wife?

I also find this line fascinating as well:

Wednesday, October 15, 2008 Lawsuit in Washington State Questions Barack Obama's Citizenship, Eligibility to be President

According to an article run yesterday by The Daily Herald in Everett, WA, a civil action was filed Tuesday in Washington State Superior Court against Sam Reed, Secretary of State for the State of Washington, demanding that Illinois Sen. Barack Obama be removed from the ballot in Washington unless he can provide verification of his status as a United States citizen.

Steven Marquis, the Fall City, WA resident who filed the suit, asks that the Secretary of State's office verify, by looking at "original or certified verifiable official documents," that Obama is a natural-born citizen of the United States and eligible to serve as president, and that the office do so by Election Day. Marquis argues that resolving, one way or another, the unanswered questions surrounding Obama's citizenship and background would "preclude a constitutional crisis and likely civil unrest" which would arise should information come to light after the election which shows that the Illinois senator is ineligible to hold the presidency.

"The complaint," states Marquis in his press release, "argues that the Secretary of State has the authority and duty to not only certify the voters but also and more importantly the candidates and, in so doing, prevent the wholesale disenfranchisement of voters who would [have] had an opportunity to choose from qualified candidates had the certification preceded the election process."

Marquis also cites, in his release, the federal action filed by Philip Berg in the Eastern District of Pennsylvania, but states mistakenly that Obama has "failed to respond to the District Court's request to produce or allow access to the official documents" and instead filed a motion to dismiss on grounds of lack of standing, when in fact the district court has not yet issued any order in relation to the underlying case, nonetheless an order compelling Obama and the DNC to produce documents. Largely, the allegations within Marquis' action look to be drawn from Philip Berg's action in Philadelphia, with the exception that Marquis has named as defendant only the Secretary of State and not Obama, the DNC, or the Federal Election Commission.
