Interview with the President: Jail Time for Those without Health Care Insurance?
ABC News ^ | 11/10/09 | Jake Tapper

Posted on 11/10/2009 8:23:25 AM PST by mkboyce

This really takes the cake:

“What I think is appropriate is that in the same way that everybody has to get auto insurance and if you don't, you're subject to some penalty, that in this situation, if you have the ability to buy insurance, it's affordable and you choose not to do so, forcing you and me and everybody else to subsidize you, you know, there's a thousand dollar hidden tax that families all across America are -- are burdened by because of the fact that people don't have health insurance, you know, there's nothing wrong with a penalty.” - Obama

Are you kidding me?!

This so-called smart man, a supposed “Constitutional scholar”, uses the simpleton’s analogy that the requirement for auto-insurance is the “same” as government requiring everyone to purchase health insurance. Last I checked, no human being was ever born with a motorized vehicle attached to his backside. Also, last I checked, Americans are born with certain inalienable rights to life, liberty and the pursuit of happiness.

How does making it a requirement to purchase something as a requisite to life, in order to be free from penalization (liberty), in any way, shape or form in-line with “truths” of the Declaration of Independence and the Constitution of the United States of America?

Barack Hussein Obama, please, for the good of the order…RESIGN NOW!

It’s a bunch of smooth talking evil.

He’s going to cost you more, deny you care, and he talks about putting you in jail because after all, he’s done so much for you.

Plus, weren’t we taught that ‘driving is a privilege not a right’?? Therefore, you ELECT to get a car and choose to drive, and then you need to get insurance. Unless you are here illegally. Then you ‘need’ to, but really, citizens will cover for you. And YOU will pay no penalties, altho citizens will.

Best to know ALL the rules — for THEE but not for me.

I would like to see minimum security jails built, then, to house scofflaws. Because I, for one, would prefer to go to jail than be forced to knuckle under to the Black Queen and the Little Emperor.

Obama’s argument doesn’t wash.

The government (state of CA) mandates me to have auto insurance to protect OTHER drivers, vehicles and property due to accidents caused by ME. That’s why I’m required to carry liability insurance but collision (coverage for my vehicle damage caused by me) is optional.

If I don’t have health insurance, I’m not hurting anyone else if I get sick.

Uh, yes you are. You are impacting the health system if you don’t have the ability to pay. That is in part why the system is so out of balance now, too many who can’t pay are still being treated by the system.

Good point. By Obama’s logic people that do not own cars should be required to purchase comprehensive auto insurance in order to spread the risk and lower costs.

Of course, when I make this point to idiot liberals who try to make the auto-insurance comparison, they roll their eyes.

Citizens and legal residents who are not citizens will be subsidizing health care for illegals, as they do now, and also for any group of Democrat voters that Obama and Pelosi want to exempt from the penalties on the "hardship" excuse.

It is really a new tax, which is the only way the government can justify taking the money, but they want to avoid calling it a tax, hoping the public will be too confused to notice.

It’s a control power grab over people’s life.

Barry is no more a “Constitutional scholar”, than I'm Albert Einstein.

This asshat 'Constitutional scholar' doesn't even know about that little thing called a Bill of Attainder which is right in Article 1, Section 8 of the Constitution. and is along with ex post facto laws, UNCONSTITUTIONAL.

Bill of Attainder
Definition: A legislative act that singles out an individual or group for punishment without a trial.
And since you, oops 'we', would be automatically found guilty, and face fine and prison without trial, for not buying Insurance, that is a Bill of Attainder.

"The Bill of Attainder Clause was intended not as a narrow, technical (and therefore soon to be outmoded) prohibition, but rather as an implementation of the separation of powers, a general safeguard against legislative exercise of the judicial function or more simply - trial by legislature."

And.....

"Bills of attainder, ex post facto laws, and laws impairing the obligations of contracts, are contrary to the first principles of the social compact, and to every principle of sound legislation. ... The sober people of America are weary of the fluctuating policy which has directed the public councils. They have seen with regret and indignation that sudden changes and legislative interferences, in cases affecting personal rights, become jobs in the hands of enterprising and influential speculators, and snares to the more-industrious and less-informed part of the community." James Madison, Federalist Number 44, 1788.

This 'thing' also violates about six amendments and is utterly and completely UNCONSTITUTIONAL.

Well, you get health care in jail. So if universal health care is the goal, then either you pay for it or you get it forced upon you! Unless of course, you are in a favored class that gets a “Get our of Jail Free Card” and get fully subsidized without incarceration.

I think it’s wise for everyone to have catastrophic health insurance to cover the most serious medical problems. But the way insurance is set up now, where every little sniffle and minor ache is paid for, this is what drives the costs up.

If everyone had to pay out of their own pocket for minor things like office visits etc. doctors would charge far less. If only things like heart surgery, etc. were covered, the overall cost of health care would drop dramatically.

Actually the analogy is much weaker than you suggest. The auto insurance one is forced to get is for doing damage to someone else's person or property with your car. I'm not aware of any state the requires a person to get insurance to cover himself or his own property. If one of my trees falls on my car I am not required to have insurance to pay for the repairs. If that same tree falls on me, Obama wants me to be covered by an insurance policy that he forced me to buy. (Force is such a nice word.)

The car insurance analogy is a bogus one. You only have to acquire car insurance if you are CHOOSING to buy a car. If I don't own a car the goberment doesn't make me buy auto insurance. Same thing for homeowners...How many homeless people does the goberment force to buy homeowners insurance??

Commie Care is the goberment forcing me to by a product I don't necessarily want against my will.

Every child will be a natural born criminal until their parents add them to their health insurance policies.

This is nothing more than social security for health care. Obama wants the healthy youth of America to pay for health care for the middle aged, while restricting health care that is no longer cost-effective for seniors.

Obama is somewhat correct in principle but a fool on execution.

It's true that emergency rooms are full of people that don't pay their medical bills. We can either refuse care to them, get someone else to pay their bills, or force them to pay up-front.

The first two choices have serious problems. The third choice seems the best.

A solution would be a subsidy paid for through sales taxes -- and that's in effect what many municipalities do right now -- though the subsidy isn't nearly enough. But it does force most people to pay something to support emergency care while being somewhat sensitive to ability to pay.

The problem with Obama's plan is that it claims to do the same, but in effect simply shifts the burden further away from free-riders.

What if someone, like me, who spent $2,000 bucks out of his own pocket to solve a little health problem. This on top of the drugs I take and the doctor/dentist visits which I pay for out of my pocket, to the tune of $150 each time.

I pay that higher fee because I want an excellent relationship with doctors and when I want to see them, I am not a burden in way to them and who doesn’t like cash.

Should I now be forced to spend at least $20,000 a year for something I will not receive same value for and will be used to subsidize others?

Think about it. That is $20,000 less and my taxes are going up next year while at the same time that State of California is with holding extra money and telling me they will give it back some day.

Tell me you think $3,000 per month less in take home isn’t going to be felt by me, the grocer, my bartender, the car wash, the mall and anyone else I use my money as a patron.

Hope my car doesn’t break down. I may not have the money to fix it.

Then the problem becomes worse.

I spend less and everyone else spends less, guess what? Layoffs and firings start happening.

It’s a great to be in AmeriKa.

He is one twisted punk and he can come out of this and say the people spoke because it came out of Congress. He will play Bush II and sign whatever comes out of Congress.

AND NO I am not saying President Bush was ‘twisted’. President Bush needed to keep the funding intact for military spending, and so he let the liberals control domestic policy.

Don’t forget a few simple things about the auto insurance argument:

1. State’s rights versus the Feds
2. Auto Insurance protects the others on the road
3. Auto Insurance is catastrophic only, it does not cover basic maintenance like tires, oil changes, etc.
4. If you don’t drive on the public roadway, you are not required to buy auto insurance.

When this “health care for all” crap passes, right now the legislation states that it will be illegal to sell private policies over the date of passage. It also says that HSA’s will no longer be allowed. That means that my current policy will no longer be allowed and neither I nor my employer will be allowed to privately purchase an alternative.

I will not accept the “public option” that I will be dictated to join. I will not give the government control over my physical body. I will not pay their fines, I will not surrender to the impending warrant for my arrest. When they knock on my door, I will not answer. When they kick it in, I will make the news.

How’s that for unification, libtards? You loons are currently legislating my death. I will chose the terms and I will bring as many of you along as possible!

What will be MANDATED by the Government next....by FORCE?

Oxygen Insurance?

Weather Insurance?

Tire Insurance?

Food Insurance?

Fat Insurance?

That's the trick. Can't sue until 'it' (in any form) becomes law.

The sickening part is only a couple Republicans in Congress have even brought up the Constitution. Michelle Bachmann was one and some guy(1) who basically said, 'Let The Court Sort It Out.' (nice attitude)

(1) Can't recall his name there's at hread on it somewhere I read a while ago. Maybe its in a link from Michelle Malkin's 'Hot Air'.

“Well, you get health care in jail.”

This is true. Prisoners are the only people with a constitutional right to health care, according to decades of court rulings. The idea being that if you deprive a person of their freedom, you then are responsible for providing the food, shelter and medical care needed to keep them healthy, i.e., it would be “cruel and unusual punishment” (hence unconstitutional) to let prisoners die of starvation for example, or let them bleed to death in their cell by refusing to provide lifesaving treatment.

Obama laments the $1000 cost these uninsured allegedly are imposing on society, so his solution is to toss them in jail where the annual cost to keep them at taxpayer expense is measured in thousands of dollars a year!

Does this mean people in Prison have to pay for their own health care?

If there is an income related cut-off, what about the independently wealthy that are in Prison.

All the wrinkles to this health care bill make my head hurt.

My sentiments exactly, unlike posts on this board, there’s a large populace that will not accept going to jail.

If the “authorities” feel so strongly about enforcing an unconstitutional jail sentence from an unconstitutional mandatory social program than they must be willing to sacrifice their own lives and their families lives.
Sorry, that’s the way it works. Live free or die.

The only difference now is that they are blatantly stating the eventual outcome of refusing to give up your liberty.

SS and Medicare were sold to the public as a benefit, yet they were presented to the USSC as a method of tax collection. I figure the current health care legislation will end up being defended in the same manner and will end up being considered a tax, yet it is being sold as a “benefit.”

Try not paying your SS or medicare tax and see what happens. The only leverage the government has over us pleebs is with the point of a gun. There is no other way of enforcement of any legislation, tax or policy.
