Florida`s Attorney General, Pam Bondi, responds in Health Care Law case

See Attorney General Pam Bondi and the 25 Other States Challenging the Federal Health Care Law File Reply Brief on Anti-Injunction Act

“The Anti-Injunction Act does not bar the Court from considering the challenge to the individual mandate because the Act imposes a 'penalty' on those who fail to get coverage, not a 'tax',” stated Attorney General Pam Bondi. “The federal government severely undermines its claim that Congress can impose the mandate under its taxation powers.”

There is but one question which Pam Bondi an other State Attorney Generals need to have the Court establish regarding the constitutionality of Obamacare. When have the American People debated granting power to Congress to enter their States and tax for, spend on and regulate their health care needs and choices, and then, as required under Article V of our Constitution, gave their consent to such power by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof? Seems to me a majority of the States have officially rejected such power being granted by filing suite in our federal district courts.

What is so difficult to understand about the un-constitutionality of Obamacare other than those who pretend the Constitution may mean whatever they wish it to mean, and without reference to the documented intentions and beliefs under which it was adopted?

The primary court argument against ObamaCare should focus on public statements made by various dimocratic congress critters when they weren't reading the bill was - ObamaCare didn't have a tax - it was a fine. Now, in court, the dimocrats justify it as a tax.

The judge should simply require the dimocrat lawyers to document what it is based on either swore affidavits from everyone who voted for it (it's a tax) or accept Congressional testimony that it isn't.

If they go the later route then have the dimocratic lawyers identify the exact clause in the Constitution have allows such an act.

Regardless which tack is taken the dimocratic lawyers will provide innumerable sound bites for the 2012 and 2014 election cycles.

But then, I want to win this one.

Pam Bondi is a f’ing whore who is part of a criminal syndicate stealing something like $100B in equity from Florida RRE mortagees.

She is an opportunistic parasite, incompetent, over her head, a pawn, the Gov Scott version of a fall gal Janet Reno.

She does NOT represent the interests of the Florida general public, she is a shill of the banks, mortgage servicers, robosigning mills, the robosigners law firms, and in this case and a myriad of other cases regarding health insurance/medicare/medicaid in FL, she is bought and paid for by the monopolistic health insurance companies in Florida.

Don’t for a second think she won’t sign off on the most watered down as possible failure of a compromise regarding ObamaCare mandates.
