THIS COULD HAPPEN TO YOU:
It started out as a leisurely sunset stroll in your typical urban neighborhood. But that's all you remember.
The nurse just informed you that you've been in a coma for three weeks. You were mugged, raped, and maimed.
"Good news," she says "It was touch and go for awhile, you're mending nicely. Your blood work indicates that the std you were infected with has cleared and no traces are evident, thanks to the new antibiotics. It will take a little practice, but you'll adapt to the new prosthesis with the help of their state of the art physical therapy program. Oh, be sure to tell the TSA agent at the airport about the metal plate in your head, else they'll think you're trying to put something past them. Rejoice! You are the recipient of all this state-of-the-art medical technology, and it's all covered by Obamacare!"
But then comes the nice man in the immaculate suit. He's not a doctor..
"Well, we're pleased that your pulling through, yess indeed! But-- ahem-- but there are some things you need to attend to, bearing on these circumstances. It's not going to be welcome news exactly, er- it looks like you should contact your lawyer-- like right now. It's pressing, actually. Your being in a coma has put you a little behind the curve. Interrogatories are expected to be complete next week, though I'm confident they can get an extension. You might want to try to sell your condo. And of course we keep a list of attorneys you can consult with, ones with extensive experience in this area. You know, there are many others in the same boat. Not uncommon at all.
Why you ask? Well, you resisted your mugger and caused him bodily harm as well as psychological trauma.Unfortunately he didn't qualify for coverage you received because he hadn't paid his premiums, nor properly completed the paperwork needed for an exemption. He's not, technically speaking, a citizen anyway. He's going to jail of course; he's not the one filing the suit. It's the hospital that treated him; you fought back pretty hard. He lost an eye. Wish you'd spoken to your attorney first, but-- well, who would think to, right? In any case, please understand, I'm just the messenger."
I propose that we set up an insurance program for victims obliged to indemnify their attackers in the event that they resist in such a way as to cause physical or emotional harm.
It shouldn't cost much more than soon-to-be obsolescent medical insurance does now.
It's an idea whose time has come. All interested parties are urged to contact me for prospectus.
Sig P220 Carry = Mugger Indemnity Insurance
Actually, that insurance exists. There’s a clause un my USAA homeowners policy that covers claims resulting from self defense, up to and including the insured’s use of a firearm in self defense.
The whole family was big on gun control, I reckon the muggers love folks like them!
“Sig P220 Carry = Mugger Indemnity Insurance”
Small but significant alteration
Sig P220 (loaded with 165g +P Corbons) Carry = Mugger Indemnity Insurance
Do make such a large, lovely hole. And with a relatively short barrel gun, even if you miss the blast will disable.
I figure there has to be something there, but does that cover you when you're outside of your house, off the property?
Thanks for the questions. I’ll check my policy and get back to you.
Coverage E defines covered "Personal Injury" to include:
h. Assault and battery if committed by any insured or at his direction to protect persons or property. This applies only when the conduct is not criminal.
'Personal injury' only applies when the conduct is not malicious or criminal in nature.
This means any of us with this coverage is likely to be covered if he uses lethal, or other, force in a legal act of self defense on or off his property, since I have seen no limitation of coverage to only on-premises use of force. However, if one of us has the great misfortune to be the shooter in a Trayvon Martin situation, coverage will most likely depend on being exonerated in any resulting criminal proceeding. Hence, those of us who pack heat legally, including yours truly, MUST always realize that the weapon is there to deal with fate if (God forbid) it comes to us, not to enable us to go out and challenge fate.
Many thanks for that , libstripper
Of course, if half a dozen thugs jump you, and there are no other witnesses to contradict their claims, it might end up including assault charges. My imaginary insurance policy would not cover criminal acts either.
I was thinking about Zimmerman’s situation. I wrote tongue in cheek, but now my tongue is in my throat.
A couple of extra points:
1. The way the endorsement Incited and quoted is numbered indicates that, at least in part, itmmainly applies to TN where Ilive, so you need to check the endorsement for your state.
2. It also looks like the policy only covers defense n a civil case, not a criminal case.
3. Be all that as it may, with Leshaun on top of me trying to murder me and me having an available revolver, I’d prefer to be judged by 12 than carried by 6.
I’d tell simply the lawyer that I won’t pay.
Ever.
The hospital can eat every last cent.
I will empty my accounts and destroy my property before they’ll get one cent.
Might even have my wife file for a divorce to keep them from getting at my assets. Even have her go through with it and let her get *everything* rather let the hospital get a cent for the care of the scumbag.
