Krauthammer: New Obama immigration policy ‘out-and-out lawlessness’

On Friday’s “Special Report” on the Fox News Channel, syndicated columnist Charles Krauthammer said that the president’s shift on enforcing immigrations laws and granting certain privileges among illegal immigrants is “out-and-out lawlessness.”

Krauthammer told host Chris Wallace that this was a so-called “end-run” around the legislative branch of the federal government and explained how it defied the Constitution.

“Beyond the pandering, beyond the politics, beyond the process — is simple constitutional decency,” Krauthammer explained. “This is out-and-out lawlessness. You had a clip of the president himself say months ago ‘I cannot do this on my own because there are laws on the books.’ Well, I have news for president — the laws remain on the books. They haven’t changed.”

He said this appears to be the White House attempting to enact the DREAM Act, which failed to pass muster with the Congress after several attempts over the past several years.

“He proposed the DREAM Act of which the executive order is a variation,” Krauthammer continued. “He proposed a DREAM Act. The Congress said no. The Congress is the one who makes the laws. What the administration does is it administers law.”

“And in fact, what it is pretending to do is to use discretion,” he said. “That’s what the Homeland Security said. This is not discretion. Discretion is when you treat it on a one-by-one basis on the grounds of extenuating circumstances. That is declaration of a new set of criteria, which is essentially resurrecting the legislation that the Congress has said no to.” (VIDEO: Neil Munro explains his exchange with President Obama in Rose Garden)

Krauthammer reminded viewers of the criticisms the Bush administration took on when some perceived it to have been overstepping its bounds, while those same detractors have little to say about this.

but it only works over time, as they can survive a single month

it’s time for an outright tax revolt. to quote NReagan ... “JUST SAY NO!”

to make this work, it would probably require the states to jump onto the 10th amendment bandwagon and stipulate that the citizens of their state pay NO federal taxes. the tax obligation is on the state, not the individual... as the founders intended. this would drive power from washdc into the hands of state officials... and you can always trust people to do what’s in their best interest. the only thing holding this back would be the commies/ progressives/ socialists at the state level that are working for the big picture

Rome continued to have a senate for over 400 years after Augustus took control of the government.

Way to beat me to it. While we're on the subject, the Founding Fathers learned well from the fall of the Roman Republic.

Even in the heyday of the Republic, Rome had a convention of suspending civil government when the city was threatened, in favour of a temporary dictator. Cincinnatus was one of those dictators. That convention was the hook that Caesar Augustus used to establish the Empire. He clothed himself in the tradition of the temporary dictators - only in his case, it was permanent.

The United States has no such loophole. Even during the Civil War, when the U.S. government was at its most tyrannical with respect to civil liberties, elections were still held on schedule. President Lincoln had to run for re-election in 1864. As confirmed by World War 2, even total war is no reason to suspend or even postpone elections. Americans have always had the right to change CinCs in mid-war, and still do.

Consequently, there's no customary loophole for a would-be Emperor to exploit. America may degenerate into a dictatorship, but it surely would be an elective dictatorship. Sadly, the continuance of elections would make such dictators claim loudly that they aren't really tyrants.

This is like the healthcare mandate about free birth control--a cynical ploy for votes.

Obama could have asked Congress to pass a law to this effect when the Democrats were in control of both houses of Congress, but he waits until the election campaign for maximum political impact, and to demonstrate his contempt for the Constitutional separation of powers.

Bill O'Reilly was in his worst Ted Baxter useful idiot mode tonight, gushing about how compassionate this is.

The last of the traditional Roman dictators (maximum term six months) were in the period of the Second Punic War in the late third century. After that you have Sulla and Julius Caesar holding dictatorships without a time limit. After Caesar's assassination, the office was abolished.

When Octavian, Marc Antony, and Lepidus joined forces in late 43 B.C., they created the Triumvirate which was in effect a three-man dictatorship, but they avoided the term "dictator." Eventually Octavian had sole control but in fashioning a legal basis for his authority after 31 B.C., he avoided the term "dictator." He had learned from his uncle's mistakes.

Yes, it is a modified “going Galt” I had that in mind as I made the suggestion.

How many States do you think would go for jumping on the 10th amendment? That is a bold and workable idea you have there. Surely there are some Governors who would take a chance if they were not “alone”.

I'm certain if “No” had been used more when the rats started biting, we wouldn't be in this fix.

For instance, what force does the EPA have to enforce their mandates? It only takes one business owner or landowner to roll over and the rest run like little girls...I am so disgusted.

You nailed it: from the beginning. So now what? Standing up to a real tyrant is suicidal. Putting this tyrant down alive looks to be almost impossible, and it would be nice to come out of this with the rule of law intact. I dunno.

As long as Mr. Dynamic is the Senate Majority Leader and the gatekeeper, nobody is going to do anything about this sad excuse for a President. The House can impeach him but it will never get to a vote in the Senate!

If an illegal alien falls just outside of the President’s definition of those given preferential treatment, will the Just Us Department process a case under “equal protection” clause of the Constitution?

Exactly! Here we have a Fuhrer decreeing crap who is above Congress, the SC and the rest of us. This guy must not only be thrown out of office but investigated to determine what else he has been up to.

If he will behave like a tyrant in full view then is this just the tip of the iceberg? What other shady deals and crap is going on that we don’t even know about?

Thanks; I'm not as much up on Roman history as I should be. It makes sense that the office would fall into desuetude, because Rome the city was no longer threatened with invasion.

You're right about him not using the exact same title; he went with Imperator, which used to be reserved for generals whose victories rated a triumph. Still, the custom - although in disuse - was there to be tapped into. Augustus could claim, plausibly, to have brought an end to the civil wars that had rent the late Republic.

because of people like you Mr. Krackhead, and the likes of the other establishment pubs, we struggle to get majorities in the House and Senate...we struggle to appoint conservative judges....

So the New Roman Republic has become the New Roman Empire. Figured we were fairly close to that point.

My guess is that Obama knows the Supreme Court will strike down his ObamaCare fiasco. So he shoves this in their face, since it will also end up in the Supreme Court. Could also be tampering with the Supremes or possibly he may be setting up precedents to ignoring the Supreme Court rulings. Lots of possibilities with this psycho.
