What If There Is NO President by January 20th

It COULD happen. At least, SOME of the political experts are saying it COULD happen.

I think America should be prepared for every sort of political gymnastics conceivable come Tuesday, November 6th, 2012. Battalions of lawyers are set to spring into action if there is a hint that Obama may lose. Planning and preparations for such an eventuality have been in progress since the early days of the Obama Administration.

Tying the election up in the courts is the plan. And these people are serious!

So what happens if, indeed the US election is tied up in the judicial system come noon on January 20th, 2013?

"In cases where a President has not been chosen by January 20 or the President-elect "fails to qualify," the Vice President-elect becomes Acting President on January 20 until there is a qualified President. If the President-elect dies before noon January 20, the Twentieth Amendment states the Vice President-elect becomes President. In cases where there is no President-elect or Vice President-elect, the Amendment also gives the Congress the authority to declare an Acting President until such time as there is a President or Vice President. At this point the Presidential Succession Act of 1947 would apply, with the office of the Presidency going to the Speaker of the House of Representatives, followed by the President pro tempore of the Senate and various Cabinet officers." OK. But how exactly is the President-elect and Vice-President-elect decided, I mean, legally decided. And here it gets cloudy and open to all sorts of legal challenges.

There are at least two schools of thought on that.

Boehner would cry and everyone else would go on with life as though nothing has happened.

It's not like "So You Want to be a Star" isn't being run or something.

This is just more scare tactics.
Just like the dumb ragheads, the nobama dems that would try this would seriously underestimate the reaction.

Nobama knows a significant number of Americans will not idley stand for this. If they try this which puts America in international danger, I see the SCOTUS and or the Mil stepping up.

He may try to “show us” with some crazy Presidential Orders, those too will be blocked. In the end nobama will sulk away after trashing the Whiteyhut.

Ain’t gonna happen.
Even their ace=in-the-hole voter fraud card won’t work
this time around because 1. They will lose by a sizable
55/45 margin, and 2. Sensing that, the electorate at large,
not even to mention the disenchanted mainstream media, will
finally see the Dems for what they are. It might be hard to imagine a state of affairs such as what’s about to come, but I think the realization is oh-so-slowly settling in that the Dems are for all practical purposes finished as a political party. For four years, they’ve gone MUCH farther than they have ever dared in pushing the envelope, in blatant demagoguery, and dishonesty, and their game is up,leaving their media handmaidens of the MSM embarrassed and not knowing just how they’re going to be expected to make fools of themselves by continuing to support Obama personally and his Agenda.

While it is not legally possible under the way elections are currently administered, I’m intrigued by the notion of splitting the current by-party pairing of the presidential and vice president candidates and having the elective office being determined by who gets the most votes (electoral or popular, take your choice). Top vote getter is the president; second is the vice president, regardless of party. If the two vice presidential candidates are the top vote getters, they take the offices.

To be honest, I wouldn’t mind also being able to directly elect all the cabinet positions. This is the way similar offices are handled at the state level and doing so at the federal level would allow really qualified candidates to directly stand for office on their own merit. Ditto for Supreme Court judges.

It should be mandatory that on every ballot, and for every office, a "None of the Above is Acceptable" box should be included as the last option.

If no true majority of registered, and ID verified, voters can agree on a winner... then that office is held Empty until the next election cycle.

Would the world really stop turning if we didn't have a POTUS for four years?

Didn’t several States decide to apportion their electoral votes by the popular vote? Colorado comes to mind.

There will be a president-elect, come what may.

Most (if not all) states have a backup plan, in case popular balloting does not produce a clear winner, wherein the state legislature chooses how the electoral votes are assigned.

In the event that one or more states fail to send in their electoral votes, then my reading of the Constitution indicates that the set of votes that ARE in will determine the winner.

Didn’t several States decide to apportion their electoral votes by the popular vote? Colorado comes to mind.

Maine and Nebraska split their electoral votes with one per Congressional district plus two at-large for the state's winner.

Colorado voted against proportional distribution in 2004. I think it died when it was apparent that in any but a landslide election their votes would be split 5-4 or 4-5.

A few states have voted for a national popular vote distribution where the nation's winner would get the state's electoral votes, but they all have a requirement that many states (maybe the majority of the Electoral College) join them before it goes into effect and that level hasn't been hit yet.
