ACT HERE & NOW TO STOP 'Sweeping Gun Control Measure In Santa Fe' [New Mexico]

I've made it easy for you to contact your New Mexico legislative representatives and TELL THEM TO OPPOSE a 'Sweeping Gun Control Measure In Santa Fe.' Use the following links/resources to: 1) find your New Mexico state senator and house rep and contact them via email, phone, and/or snail-mail; 2) use sample letter text; and, 3) contact every member of the New Mexico House Judiciary Committee because they're holding a public hearing Monday on the "Sweeping Gun Control Measure":

I urge you to oppose House Bill 77 introduced by Representative Miguel Garcia (D-ABQ). I believe his legislation is a 1) direct threat to civilian gun rights and ownership as granted New Mexico citizens under ARTICLE II - BILL OF RIGHTS, Sec. 6. of the New Mexico Constitution; and, 2) a direct threat to civilian gun rights and ownership as granted American citizens under the Second Amendment of the U.S. Constitution.

As I understand it, HB 77 would require good citizens to register their firearms with the state. When I think of requiring good citizens to be placed on "lists," I think of what good people endured because of "lists" under Hitler and Stalin. Crazy people and thugs will not register their guns, so what is the purpose of requiring law-abiding citizens to do so? This scares me.

How can HB 77 require gun registration and regulate the private transfer of firearms between family members, friends and co-workers when the U.S. Constitution simply states that "the right of the people to keep and bear arms, shall not be infringed," and the New Mexico Constitution simply states that "No law shall abridge the right of the citizen to keep and bear arms for security and defense... No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms?"

Please do all you can to prevent HB 77 from becoming law.

House Bill 77, state Representative Miguel Garcia's sweeping gun control bill to regulate all private gun transfers, establish a state registry of lawful firearms owners and tax legal gun purchasers will be heard by the House Judiciary Committee on Monday, January 28, at 1:30 pm or upon adjournment of the House in Room 309 of the State Capitol in Santa Fe.

It is extremely important that as many people as possible attend and speak in opposition to this measure. This committee normally asks for a show of hands in the room for and against bills, and then allows each person to stand up and briefly speak from their seat. Arguments should be clear, concise and not repetitive. Please speak to HB 77, not to other gun control proposals in Washington or other gun-related bills filed in New Mexico.

Hey, thanks to all of you who were willing to help us out in New Mexico by spreading this (or any other pro-gun) link around. We have a tradition of solid support for guns — generally. The state capital is a crunchy granola, Birkenstock, falafel shampoo haven though — Santa Fe. And the “progressives” are taking full advantage of the recent massacres and Obama/Feinstein-led trashing of the 2nd Amendment.

The title of the bill tells all you need to know about what the gun-grabbers want to do and how overreaching this bill is:

AN ACT RELATING TO FIREARMS; CREATING THE FIREARM TRANSFER ACT; PROHIBITING CERTAIN PERSONS FROM PURCHASING OR RECEIVING FIREARMS; REQUIRING BACKGROUND CHECKS BY THE DEPARTMENT OF PUBLIC SAFETY PRIOR TO THE TRANSFER OF FIREARMS BY PERSONS OTHER THAN LICENSED GUN DEALERS; ESTABLISHING PROCEDURES FOR THE CONDUCT OF BACKGROUND CHECKS; ADDRESSING PRIVATE TRANSFERS AND TRANSFERS AT GUN SHOWS; CREATING IMMUNITY FROM CIVIL LIABILITY; PROVIDING EXCLUSIONS FROM THE REQUIREMENTS OF THE FIREARM TRANSFER ACT; PROVIDING FOR RULEMAKING; ALLOWING ASSESSMENT OF AN ADMINISTRATIVE FEE; CREATING CRIMES AND IMPOSING CRIMINAL PENALTIES FOR VIOLATIONS OF PROVISIONS OF THE FIREARM TRANSFER ACT; CREATING THE FIREARM TRANSFER FUND; MAKING AN APPROPRIATION.

And from the NM State Constitution:

“No law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons. No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms.” Article II, Section 6.

So it's pretty obvious that the law would be unconstitutional though NM's liberal judges would likely not see it that way.

New Mexico Family Gun Shop Owners Get New Trial

Last summer, I told you about the Reese family in Deming, New Mexico. Rick and Terri Reese, along with their two sons Ryin and Remington ran a gun shop. They kept meticulous records and ran their successful business according to the letter of the law. Then suddenly, they found themselves charged with violating federal gun trafficking laws. They were arrested and the feds seized the gun shop along with its $2 million worth of inventory which included all of the guns, gun records and nearly two millions rounds of ammunition. The feds also seized all of the family’s personal possessions, including their home, cars, bank accounts, jewelry, gold and coin collections all totaling about half a million dollars.

More than six months after being jailed, Terri Reese was finally allowed to post bail in March of 2012 and get out of jail, but her husband and two sons were denied the same opportunity because the prosecution claimed they were dangerous and posed a flight risk. The father and sons were held over pending their trials.

In July 2012, son Remington was acquitted of all charges and set free. Rick and Terri were each found guilty of one count of lying on firearms purchase forms. Son Ryin was found guilty on two counts of lying on federal purchase forms. All members of family were acquitted on the other 24 charges that had been brought against them.

Even though the trial was last July, Rick and Ryin Reese remain in jail pending their sentence hearing which has never taken place. All toll, the father and son have spent nearly a year and half in jail.
