Yes, He Can: Twenty Ways Obama Can Use Executive Power to Push a Progressive Agenda

When President Obama announced his sweeping new plan for preventing gun violence on January 16, it included no fewer than twenty-three “executive actions,” in addition to a series of legislative proposals. The message was clear: in the face of congressional intransigence—on gun control and beyond—Obama will push changes through the executive branch that he believes to be for the good of the country. “Congress too must act, and Congress must act soon,” Obama said, while making it clear that the White House will not wait for the GOP-controlled House.

It was not the first time the president has flexed his executive muscle. Obama deployed such power during his first term on a number of notable occasions. The “Mini–Dream Act” executive action, for example, was hugely successful, both in terms of public policy and progressive politics. It helped people in an immediate and tangible way, was enormously popular with Latinos and Asian-Americans, and may well have won him re-election.

Others, like raising the CAFE standards to demand better fuel efficiency from carmakers and capping student loan payments, were part of the Obama administration’s “We Can’t Wait” initiative, launched in the fall of 2011, following the debt ceiling fiasco and the House Republicans’ refusal to seriously consider the American Jobs Act. “We can’t wait for an increasingly dysfunctional Congress to do its job,” Obama said at the time. “Where they won’t act, I will.”

The president has also acted through the appointment process. He made a recess appointment of Richard Cordray to head the Consumer Financial Protection Bureau, despite intense congressional opposition, and another three recess appointments to the five-member National Labor Relations Board, putting it back in action after the Republicans refused for months to confirm any new members...

The sum total of owebama’s “executive actions” was this:

“Hey you guys, do your jobs.”

Unfortunately biteme says they don’t have time to prosecute criminals who get caught by NICS as being inelegible to purchase a firearm.

They don’t try to register illegal aliens but they want law-abiding American citizens to register their firearms. Hey, it makes perfect sense to libtards.

The Founding States had made the first three numbered clauses in the Constitution (good place to hide them /sarc), Sections 1-3 of Article I, to clarify that all legislative powers of the federal government are vested in the elected members of Congress, not in the Oval Office or with the Surpreme Court.

In fact, the Supreme Court had reflected on the above referenced clauses in Youngstown Sheet & Tube Co. v. Sawyer by clarifying that constitutionally undefined executive orders don't have the force of law unless an order is backed by legislative action by Congress.

Executive Order

So the idea of Obama using executive orders to bypass Congress is absurd since executive orders must have Congress's support. In other words, Obama is trying to use executive orders to posture himself as a king, actually relying on widespread ignorance of the Constitution to play this game.

And Obama shouldn't hold his breath waiting for Congress to make gun control bills either. This is because the Supreme Court has also clarified that the purpose of the 2nd Amendment is the following. The 2nd Amendment was intended to clarify that the natural right of citizens to defend themselves is basically beyond Congress's control, 2nd Amendment or no 2nd Amendment.

"The second and tenth counts are equally defective. The right there specified is that of "bearing arms for a lawful purpose." This is not a right granted by the Constitution. Neither is it in any manner dependent upon that instrument for its existence. The second amendment declares that it shall not be infringed, but this, as has been seen, means no more than that it shall not be infringed by Congress. This is one of the amendments that has no other effect than to restrict the powers of the national government, leaving the people to look for their protection against any violation by their fellow citizens of the rights it recognizes (emphasis added), to what is called, in The City of New York v. Miln, 11 Pet. 139, the "powers which relate to merely municipal legislation, or what was, perhaps, more properly called internal police," "not surrendered or restrained" by the Constitution of the United States." --United States v. Cruikshank, 1875.

The bottom line is this. Given that Obama shouldn't be waiting for gun control bills that the Founding States restricted Congress from making anyway, Obama can make paper airplanes out of such orders.
