Obama considers revoking trademark protection for the Washington Redskins’ name because some people said it was offensive

It was recently reported that the Obama administration was considering revoking trademark protection for the Washington Redskins’ name because some people said it was offensive.

This could set a horrible precedent.

Just about every R-rated movie includes content that someone would consider offensive, whether that content be violence, sex, profanity, etc. The same can be said for the content of many books, the lyrics of many songs, the content of many paintings, etc. If any copyright, patent, trademark, etc., can be revoked because someone finds it offensive, then I can’t even begin to imagine how much damage this would cause to the concept of intellectual property, as well as to the arts, sciences, music, literature, movies, etc.

There is no such thing as a right to not be offended. The whole point of protecting free speech in the first place is to protect speech that some people might find offensive. If we only protected speech that was dull, bland, and non-controversial, there wouldn’t be much point to having such protection in the first place.

Does the president control the Patent Office? Is there a process for “revoking” a patent? Aside from his utter hubris, what makes the Clown Prince think he can just arbitrarily take away a trademark?

And if you think about it, this might just come back to bite him. After all, if you remove the trademark protection from the Redskins name and logo, it becomes public domain. ANYBODY can use it. I know I would develop a sudden fancy for Redskin t-shirts, especially if I could sell them for $25 apiece.

The Redskin name would be everywhere!

There is a provision in the trademark statute that prevents registration of a mark deemed to be scandalous or immoral. I could be wrong but if memory serves that seems to apply to new marks for which registration is sought and not as a vehicle to strike from the register an existing registration that, in someone’s hindsight, becomes “offensive.” At any rate, there is nothing Obama can do about preventing the Redskins from co to using to enforce their common law rights.

Given the new focus on income inequality, can Obama revoke the trademarks and patents that Microsoft and Apple have, because the profits that Bill Gates and Steve Jobs made are "offensive" to the poor?

I do not see why we are giving him such a rough time.

He is willing to take on the HARD TASKS such as
USSR and their stand against gays,
names of football teams,
brackets for the NCAA tournament,
concussions for football players,
intervening in local govt and opining on criminal matters,
and many more trivial matters.
ETC.....


He has time to call some queer football player..but won’t even acknowledge Pearl Harbor or D-Day or call the family of a slain soldier..
