Of course the real story is being overlooked here...

WASHINGTON – A Justice Department official on Friday defended the legality of a program to scoop up data from thousands of mobile phones as the secret operation came under scrutiny from lawmakers and caught the federal agency that regulates the nation’s airwaves by surprise.

The Justice Department, without formally acknowledging the existence of the program, defended the legality of the operation by the U.S. Marshals Service, saying the agency doesn’t maintain a database of everyday Americans’ cellphones.

Whether they maintain such a database is immaterial to the underlying issue, which is simply this: It is unlawful for the Marshal's service to operate a radio transmitter on any other than a licensed frequency.

There are no lawful users of those frequencies other than the licensees.

By operating an unlicensed transmitter without the explicit permission of the cell carriers the Marshal's service is breaking the law -- a law that carries severe criminal penalties.

It doesn't matter if the interception itself is lawful -- the means of interception they are using is not.

Period, end of discussion, full-stop.

Why should you, or anyone else, obey the law -- any law -- when the government itself refuses on a literal hourly basis across virtually every agency to do so?

I have a cell phone that is rarely used except for emergencies.

Don't really believe this type of operation applies to me, but nevertheless, it is illegal. The DOJ should cease such activities immediately.

Huh! Fat chance.

Why is every one UPSET? Didn’t the majority of them vote for all of this? And given another chance to vote for these people, they would do it again and again.They really don’t give a damned what these lawmakers do, as long as the government continues giving all these “FREEBIES”. These people are preparing all of us for SLAVERY, by putting all of us in the GOVERNMENT PLANTATION. Those that refuse to go to the government plantation, will be cut off from everything. Eventually, even those will be convinced to go to the government plantation or starve to death.

I think the problem is that they are shaking down anyone, not who the targets are.

Lawlessness is rebellion in its most blatant form. When the people or the government are committed to lawlessness, they are rebelling against those who hold authority over them and undermining their authority to try to free themselves from that authority.

What was done when I was a child and I rebelled against my parents? I got a whippen across my seat of knowledge that taught me that there is a price to be paid for said rebellion. If the rebellious child was smart they learned a valuable lesson in the price of lawlessness. If not, the lawlessness grew quietly but with vengeance and malice at its heart, though feigning submission.

This government is lawlessness defined. They are rebelling against the citizens of this country who are the real power behind this government as written in the Declaration of Independence, from whom this government draws its power.

It is time for our government to be taken to the wood shed through the ballot box and vote ALL politicians who rebel against the will of the people out of office, after all, WE put them there in the first place. Do not listen to what they say, LOOK at what they did/do and make your decision based on their actions, NOT their words.

(P.S. I agree with you GeronL)

Gosh, i remember back in the bad old days that we had to fight Communism because they would impose a police state with listening devices, pervasive government spying, secret policemen....

Now we’re told its “ regrettable but necessary” but not that bad cuz they wont do anything with all the information the get on all of us.

Tell it to Lois Lerner....

Why does anyone? Why purchase Obamacare? You want to kill it? Do not buy it.

That is the game they are playing. That is why a dipwad like Gruber makes fun of the citizens.

To put it succinctly, in the United States, the People are Sovereign.

And the tool that the Sovereign people are supposed to be able to use is the Grand Jury.

But what if the overseers of the Grand Jury are themselves corrupt?

We have now seen that a criminal Justice Department is nearly impossible to reign in, and they are the conduit to a Grand Jury indictment.

The Congress is supposed to be the backup, but it is obvious they are almost toothless - concerned mainly with re- election, so all we get is a little grandstanding.

In California there is one twist on the Grand Jury that is actually useful - County Grand Juries focus on issues with the government, and either pick their topic or look to citizen complaints to decide what merits investigation.

Something similar at the Federal level would make sense - perhaps one in each Federal Court district, or each state. Federal prosecutors would not decide the agenda, the Jury would.

But they would retain power of Indictment.

Deal with that, Mr. Holder.

Yep — Just remember that it operates under the same justification that is used for the War on Drugs: that congress has authority over intrastate commerce via the [interstate] commerce clause, which the USSC has expanded to include non-commerce.

But there's presentment as well — though we may need to pass a Constitutional Amendment in order to get that power recognized by the government:

Grand Jury Amendment
Section I
The Grand Jury is hereby recognized as an independent, self-directing body of inquisitors comprised of citizens with power to pursue any unlawful conduct to its source, including the government itself.

Section II
All government agents, officers, judges, justices, employees, representatives, or congressmen may be held to account for obstructing a Grand Jury — upon conviction in a jury trial they shall be fined up to six month’s pay (but not less than one) and may be jailed for an equal term.

Section III
Any judge or prosecutor refusing to act upon a Presentment shall immediately be evicted from office.

Section IV
No member of a Grand Jury shall be involuntarily removed for any cause except felony or Treason.

Section V
The local Sheriff of each county shall appoint the members of the federal Grand Jury for that county within two months after his election and their term shall be of the same length of time as the Sherif but starting six month after the start of his tenure.

Because we are a constitutional republic it doesn’t matter what the people think. The government is limited by the constitution. If the people want something else they have to amend the constitution to get it. It is the responsibility of the congress to enforce the constitution upon a recalcitrant government. If they fail it is up to the armed forces. If the armed forces fail it is up to us. Congress do your damn job.
