If that were the case, no such cases could be ever be prosecuted. There are procedures to conduct prosecutions where classified material is involved.
The FBI’s first priority mission is counter-intelligence, ahead of law enforcement. They are specialists in prosecuting cases involving highly classified material.
She might charge her with a misdemeanor and let the media pretend equivalence with General Petreus.

One theory I have heard, is that they may be waiting until Hillary accumulates enough delegates to block Bernie Sanders’ path to the nomination, before Hillary has to withdraw.
Then Joe Biden can ride into the convention as the Party’s savior.

Beyond the secret info on the unsecured server and whoever hacked it and got access to that info and what they did with it, there are some 58,000 emails supposedly. Think of how many government officials this thing is going to reach out to. Then there is the Clinton foundation and what contacts and favors Hillary did for people and countries after money flowed into her family foundation.
In the end serving Hillary up as the scapegoat and letting the rest scrape by might be the happiest solution for the Washington crowd because this thing has the huge possibility of seeing many, many Washington dem insiders going to jail. Obama even received and sent emails to her through this server.
