NJ Housing Developer Bans Guns On Rental Property

While homeownership may be a key part of the American dream, a lot of people rent their homes. Why they do it is irrelevant. What matters is that their money is good and they are (usually) good tenants, right?

It seems that’s not enough for one New Jersey outfit. They also want to tell you that you’re not allowed to own guns if you want to live in one of their properties.

Another “nobody is trying to take your guns” success story. It has come to our attention that a housing development group called RPM Development Group is prohibiting their tenants from owning firearms. You have two choices: keep your gun(s) or become homeless. A new low for the anti-gun bigots!

While Mom’s Demand Action claims that “nobody wants to take your guns away,” one common theme keeps happening: our guns are being taken away either by usurpation or now by being barred from having them in our rental apartments. Despite the fact that the Supreme Court’s Heller decision states that we have a constitutional right to own and bear firearms in our homes, RPM Development Group believes they are immune.

Landlords can't discriminate based on gender, race, age or various other reasons, but apparently 2nd Amendment supporters are no longer a Constitutionally protected class.

Will this travesty pass Constitutional muster?

No. Renting property doesn’t give up your rights.

This is unconstitutional on its face just as forcing renters to attend or not attend church.

But if they want to go for it - then forcing all renters to be heterosexual should be perfectly valid - right?

If it’s not in the lease, eff em. When the lease comes due, then they can require this if people want to re-up. But if they can change that in the middle of the lease (agreement/contract), then why shouldn’t the tenants “announce” that they’ve unilaterally decided the rent just went down $200/mo.

After the quite recent SCOTUS decision in Catano v Massachusetts (9-0 vote...2016) I'm confident that the current court accepts 2A.So to these tenants I say “Federal Court” and I'd love to see the NRA finance their effort.

I am sure the local burglars will take notice and adhere to the rules.

I would assume this would increase the obligations and the responsibility of the owner to provide security with a corresponding increase in liability for failing to do so.

Pretty sure you would have to do a change of lease agreement on this. You have to send one to each tenant and have them sign it. You also have to put a start date that is 30 days (or more) from when they receive it.

Notice the geniuses have also banned any law enforcement as well, with their Diktat.

To my way of thinking that should be the law. You want “Gun Free” have at it. But you can’t call the cips either.

What’s surprising to me is the liability. It’s all very well to prohibit the fundamental right of self-defense - at that point then they are responsible for everything that happens. Why haven’t thesr places been sued to oblivion is one of those imponderables.

With the schools the principle is “In Loco Parentis”, a Latin phrase meaning the schools and teachers are acting as parents.

Not very good parents, if you hadn’t noticed. To add insult to injury when the nutjob leftists and wackjobs perpetrate these atrocities, then they blame everybody that didn’t do it. Or the NRA, etc.

Truly wicked people. And the Amazing Spineless Republicans? No pushback. Take the fight to them. Move the ball forward. That’s what you’re paid to do. Pass legislation that pritects landlords.

Because that’s probably what drives this. A requirement to post a bit of sophistry, a bit of virtue signaling, leave the tenants defenseless, is enough to keep their insurance co. policy.

Leftists are well known for effecting their odious schemes outside legislative or lawful methods, we see this iver and iver again.
