.. violated the Takings Clause of the Fifth Amendment which states that private property can’t be taken for public use without compensation.

Will this suit be successful?

I hope so, but I'm not optimistic that it will be. The takings clause does not apply to contraband, and bump stocks were turned into contraband by the ATF ruling.

“Will this suit be successful?”

Probably, in an ultimate sense...as long as it is not filed in the jurisdiction of the 9th CIRCUS!

No, it will NOT be successful because the government didn’t TAKE any property away. They just declared it illegal to possess. Technicalities will trip you up every time.

It seems to be ex post facto as well. But ATF was just following Sessions orders.

I wonder how many bump stocks were recently lost in tragic boating accidents?

***Two former retailers of now-banned bump stock devices are suing the federal government for damages they incurred after having to destroy their inventory.***

Should have taken them to several gun shows, put a sign on them....”FREE WHILE THEY ARE LEGAL!” and not destroyed them. Donations accepted.

I anticipate a ban on thick rubber bands next. I can accomplish much the same as a bump stock by wrapping a thick rubber band around an AR-15’s trigger, so as to maintain a forward pressure on the trigger, and affix the other end to the pistol grip. By pulling forward on the fore end, and maintaining pressure on the trigger, I can get the same effect as a bump stock.

So ATF can arbitrarily redefine rubber bands as “machine guns.” Gun control Newspeak.

Yet to outlaw trigger fingers or belt loops.

I almost think Trump pushed this into the light to destroy the gun grabbers.

They will be crushed in court.

Keep your powder dry.

If it fails based on Takings can it succeed based on Ex Post Facto?

Hmmm. $150. more or less, per each, at retail Call 1t $100 each dealer cost, times 75,000 stocks. $750,000. Doesn't hardly seem like it's worth a decent lawyer's time.
Two possibilities: either somebody is working for the principle of the thing, or the fix is in. Watch this one.
