Today “justice” considers things like that.
Many of these DA’s have political aspirations. Even if that isn’t the case, they still worry about the fallout (protests/riots etc)... Even if it’s not a personal conviction or bias, they still think about the impact it will have if they don’t do something.
If I were Alba it would be tempting to do so, consequences be damned.
His counter lawsuit will rival Rittenhouse. Alba will be a RICH older man soon.

There is a view among all statists, that you can’t have any power, or “justice,” which comes from outside the State. Thugs and muggers are, almost by definition, disorganized and anti-social. They are never a threat to state power.
But recognizing the rights of civil society to self determination, self-defense, property and privacy is indeed a threat. People self-organized in such a way can not be easily controlled.

We have a "Pretense-of-Law" to keep people quiet and hopeful that justice may prevail. But there is no restoration from a malicious prosecution. Actual "Rule-of-Law" has been gone for some time.
Lawsuits that win money for victims of unjust government actions have about the same odds as a lottery ticket.
