Orly Taitz asks Land to recuse himself
edger- enquirer.com ^ | October 4, 2009 | ALAN RIQUELMY

Attorney Orly Taitz, the “birther” lawyer under threat of sanctions by U.S. District Court Judge Clay Land for filing a “frivolous” lawsuit, filed a motion Friday asking the judge to recuse himself because of personal contacts and financial stakes he may have with President Barack Obama’s administration.

Land was appointed to the bench by President George W. Bush.

Taitz represented Army Capt. Connie Rhodes when she filed a Sept. 4 complaint arguing Rhodes shouldn’t be deployed to Iraq because Obama couldn’t legitimately hold office. Land not only ruled against Rhodes, but ordered Taitz to explain why he should not fine her $10,000 for filing a “frivolous” lawsuit.

On Friday, Taitz asked for an extension to respond to that order, but also asked that Land recuse himself from the case. In her motion for recusal, Taitz:

* States Land may have improperly been in contact with U.S. Attorney General Eric Holder.

* States that Land’s ownership of stock in Microsoft and Comcast could give the judge a financial stake in the outcome.

* Likens her plight to that of the late civil rights icon Thurgood Marshall in the 1940s and ’50s.

“The primary reason for the undersigned counsel to file this motion to recuse, however, is that Judge Clay D. Land has by his own actions created a constitutionally intolerable situation in which he is both complaining party, prosecuting attorney, judge and jury regarding the charges of frivolous filing and sanctionable conduct which he has leveled ...” Taitz states.

“What, for example, was ever more political in 20th century Georgia than the question of school desegregation?” Taitz asks. “Surely this distinguished southern judge would have jailed Thurgood Marshall in the 1940s and ’50s for contempt when the future Supreme Court justice repeatedly filed cases demanding on constitutional as well as ...

If your hopes are pinned on Taitz, then be prepared for a dump.

Maybe he’ll declare her incompetent and rescind the fine.

Orly is the only one doing anything. She has my full support.
And I hope she continues until the courts examine the evidence and set a precedent that people can challenge the qualifications.

Have to agree with Orly. Judge Land showed his hand when he caller her a “birther”. What a jerk.

In terms of time and money what do all y’all have tied up in bringing obama’s charade to an end?

I posted this on another thread, cross posting it he for further discussion...

I wonder really, just how the media (including) Fox would react if this all came to pass that Obama indeed had no birth certificate and his COLB was a either fake or was issued under some obscure Hawaiian rule/law where anyone could obtain one, that all along this was not just some right wing nut conspiracy, but a true liberal cover up of presidential proportions, wonder how they would react?

I mean, come on... in a single instant anyone who ignored this, pewed this or went out of their way to discredit and attack this would be reduced to what?

And how would America react or better yet how would the world react?

Would liberals stand tall and unite behind Bambi, or would they throw him under the constitutional bus to save what little face they might have left?

Would the liberal media be able to survive this considering just how low they sunk during his campaign, to levels where they were no longer just biased but completely complicit in selling him as a moderate to the people when infact he was a fraud and a socialist?

Would Bambi’s true followers believe it or cry foul and go after the right?

What about the race (X) factor?

Just how big of a mess would this actually create?

Imagine, he would now be found unqualified to hold office, committed God only knows how many crimes/felonies just to perpetrate the ultimate fraud upon America. So what about every Bill or Executive Order he has signed? What about every Agreement he has entered the US of A into with other countries?

What about his time in the Senate?

All the military or covert ops orders where he may have ordered troops and or CIA personnel to engage in deadly force under the auspice he held such authority which he would actually not have?

Would we ever be able to unwind the constitutional nightmare this would cause and how the hell would you try him?

Would Joe Biden just quickly pardon him and if so just how suicidal would that move be for Biden and the Democrats?

Just points to ponder...

Orly Taitz has devoted her life, however imperfectly, to peacefully saving America from the communist muslim imposter in the Oval Office. Win or lose, Orly Taitz is an American hero. May God protect Orly Taitz and the United States of America.

I really don’t know what to make of conservatives who heap abuse on Orly Taitz. Are you all suffering from some weird variant of the Stockholm syndrome, in which you identify with your oppressor in what you assume is a hopeless situation? I have the feeling that back in 1778 you would have been heaping your abuse on George Washington, and his hopeless war against the British Empire.

You can always hope that everyone’s hope to find out the truth about Obama’s Presidential qualifications are dumped. They won’t be. Orly is just one front.

Orly Taitz is actually an impediment. She’s made no progress, and only damaged public perception of those who question Obama’s eligibility for office. She likely has poisoned the well for any future, legitimate legal challenges.

The woman is incompetent as an attorney, and is prone to hysterical diatribes against the very figures she should be persuading and at least currying some degree of favor or even some level of respect at a minimum. She’s not done that, not even close. She’s attacked the Chief Justice of the Supreme Court, not just Land and others. I’ve been watching this with extreme interest from the very outset, and to say that Taitz’ performance is dismaying to me is a gross understatement.

If any serious consideration of the legitimate questions over Obama’s natural-born citizen status or the lack of it is ever undertaken, it won’t be due to anything Orly Taitz has done, it will be in spite of it.

“Orly is the only one doing anything”

DTN, surely not the only one. I also support her all the same.

Its a sad day indeed whicheth come when an honest, relevant question can not finde actual adjudication due to a pervasive tapestry if interstate corruption.

“any future, legitimate legal challenges”

What a joke! When will these “future challenges take place, in 2020? By then we will be dead or in gulags, and our grandchildren will be chanting hymns to Lord Obama.

Orly Taitz is doing the job right now to the best of her limited abilities. And what are you doing? Nothing, I am quite confident in surmising. One Orly Taitz is worth a thousand of you.

Rly must be onto something. 90% of the people on this thread cannot wait to trash her when their arguments are baseless. Orly has the courage of a titan because she understands tyranny and knows she cannot back down. Too bad the 90% here are too stupid to realize we see right through them.

They aren’t conservatives. They never dump on 0bama, they get their jollies harrassing people on these threads. That’s it. Check their posting history. Some of them do post on other threads but they are not conservatives. Some are one note johnnies and derive pleasure - as more than one has stated - from hassling and disrupting threads.

Orly Taitz is not ever going to accomplish anything but to discredit people such as myself, who want to see the Constitution upheld, and the matter resolved.

You apparently enjoy the deliberate, breathless, strung-out blog-hit-o-rama, with all the patented, bizarre Orly misinterpretations of every single routine action or statement from the courts. I don’t. It’s pointless foolishness, other than for those who stand to make a buck or two with their flippin’ stupid blogs.

As for your ad hominem directed at me, you have no idea what I have or have not done, and your opinion about my worth and twenty-five cents won’t even get you a cup of coffee.

But, by all means, continue gibbering and cavorting about in the funhouse with Orly Taitz. It’s your prerogative. It’s my prerogative to call it stupid, though, and stupid it most definitely is.
