Isn’t this illegal age discrimination. Also clauses that are illegal or agains public policy can be declared void and unenforceable.

Sure this is not in the by-laws, but life happens. Force them out, the remaining old farts deserve to live with that choice, and I’m sure with the right lawyer can prove that the law’s on their side.
Just one more reason to never join an HOA. Frankly, I’d like to see them all made voluntary.
Just being old, and looking like grandparents, doesn’t make you a decent person. Back in 1948, some modern 78 year old was a selfish 17-year old bully nobody ever liked. And they fill associations today.
There’s a fine line between an association legitimately guarding property values, and old busybodies just pushing someone around because they can.
Well, nevermind it said “as an infant”. Still, can’t see much harm. They are hiding behind a trivial agreement as an explanation, for visiting misery on some people trying to do a good thing.
Maybe they could rent their condo out - and rent an apartment that takes kids... in a few years - sell...
I would not want to live any place that would throw a 6 year old and her grandparents out on the street. No wonder they can’t sell the condo.
I’d like to point out that the couple voluntarily moved into this community with full knowledge, and we would assume approval of the rules.
One does not choose to visit a whorehouse and then complain about the lack of decorum.
Yes, they moved into a retirement community, and yes, they have every right to enforce their rules since they are well known and agreed up front.
However, they failed to enforce the rule for six years. There’s a fair argument that the rules are only enforced capriciously, and that undermines their case.
A fair compromise might be for the HOA to offer to buy their house at a fair price, perhaps set by a judge.
Florida law allows up to a specific percentage of non compliant residences in order to accomodate may december marriages.

As a teenager, my family lived in a retirement community... one where no children (teenagers, too) were allowed.
That said, they did allow exceptions. The lease required that any child would have to follow community guidelines, specially noise guidelines - on pain of immediate lease termination.
Most places, I expect, allow exceptions like those above.
So, I’m thinking the little kid is a really hellion, for the retirees to be so up-in-arms over a 6-year old.
