AMENDMENT OFFERED BY MR. HUGHES TO THE AMENDMENT, AS AMENDED, OFFERED BY MR. VOLKMER AS A SUBSTITUTE FOR THE JUDICIARY COMMITTEE AMENDMENT IN THE NATURE OF A SUBSTITUTE, AS AMENDED

Mr. HUGHES. Mr. Chairman, I offer an amendment to the amendment offered as a substitute for the committee amendment in the nature of a substitute. PARLIAMENTARY INQUIRY Mr. VOLKMER. Mr. Chairman, I have a parliamentary inquiry. The CHAIRMAN. The gentleman will state it. Mr. VOLKMER. Mr. Chairman, before the amendment is read, I would like to know if the amendment was one of those printed in the RECORD prior to today. The CHAIRMAN. The Chair will so inquire of the gentleman from New Jersey whether his amendment has been printed in the RECORD? Mr. HUGHES. It has been printed in the RECORD, Mr. Chairman. The CHAIRMAN. The Clerk will read. Mr. VOLKMER. Mr. Chairman, has it been printed in the RECORD by Mr. HUGHES? The CHAIRMAN. Under the rule, it is not required that the sponsor of the amendment have it printed in the RECORD. The Clerk will report the amendment. The Clerk read as follows: Amendment offered by Mr. HUGHES to the amendment as amended, offered by Mr. VOLKMER as a substitute for the Judiciary Committee amendment in the nature of a substitute, as amended: Section 102 of the matter proposed to be inserted is amended- (1) in paragraph (7), by striking out "and"; (2) in paragraph (8), by striking out the period at the end and inserting in lieu thereof "; and"; and (3) by adding at the end the following: (9) by inserting after the subsection added by paragraph (8) of this section the following: "(o)(1) Except as provided in paragraph (2), it shall be unlawful for any person to transfer or possess a machinegun. "(2) This subsection does not apply with respect to- "(A) a transfer to or by, or possession by or under the authority of, the United States or any department or agency thereof or a State, or a department, agency, or political subdivision thereof; or "(B) any lawful transfer or lawful possession of a machinegun that was lawfully possessed before the date this subsection takes effect.". Section 110 of the matter proposed to be inserted is amended by adding at the end the following: (c) MACHINEGUN PROHIBITION.-Section 102(9) shall take effect on the date of the enactment of this Act. Mr. HUGHES (during the reading). Mr. Chairman, I ask unanimous consent that the amendment be considered as read and printed in the RECORD. The CHAIRMAN. Is there objection to the request of the gentleman from New Jersey? Mr. WALKER. Mr. Chairman, I object. The CHAIRMAN. Objection is heard. The Clerk continued the reading of the amendment. I ask my colleagues, in all fairness and rationality-we only have 3 minutes left-to give me an opportunity to explain why machineguns should be banned. Mr. WALKER. Mr. Chairman, I renew my request for a waiver of the reading of the amendment. I do not know why anyone would object to the banning of machineguns. The CHAIRMAN. If it is real, we need to do something about this. What, I have no idea... But this reeks of corruption.

I am not accustomed to reading this type of transcript of an amendment to an amendment to an amendment. Please explain exactly what the fuss is all about.

This looks like a rollcall vote from the early to mid 1980’s on banning certain types of guns/weapons.

We need the Date of the Congressional Record, the full range of page numbers, and the fact that it was part of the transcript of the House’s daily proceedings.

Notice the names of Boland, Akaka, etc. as members of the HOUSE. AKAKA later became a senator, much to our sorrow.

specifically, this comes from 1986. This is the transcript of the debate on the machine gun ban. For years, we’ve said that it didn’t really pass... now we have the proof. We need to see what recourse is available to get the law stricken from the books as it DID NOT really pass.

Oh, you mean the 1300 people that have served or are now serving time for violation of this illegitimate amendment? How about the people and animals that were harmed or killed in raids conducted by BATFE over this?

Rangel owes every person in jail an apology and reparations for what he caused to happen. Then Rangel needs to go to jail.

Passed the information along to Cato and other interested parties. We may have grounds to overturn the Hughes Amendment. It’s gonna take time and there is no guarantee that it will work but there is apparantly a basis for a case.

Ok guys,

I found it.

Cspan doesn’t have the footage, nor does vanderbuilt or any of the other major video archives that I had access to.

HOWEVER

The good ol library of congress has a film reel copy.

The reel we need is:

So... Now I just need to pony up a couple hundered bucks to the library of congress and complete my order form (I just have to ask my wife when she gets back from work where the address of the new appartment is).

Rush service is not available so we’d be looking at a month or two before we can actually see it.

According to Thomas, Amendment 777 to H.R. 4332 passed on 10 APR 86 by a voice vote. The other two amendments from Hughes failed in recorded votes.

That was some dirty dealing.

Excellent. Great job. We’ve got about 5 different avenues of attack on the Hughes Amendment being put together right now. One way or another, it’s going bye bye.

We may see the demise of the garbage from BATFE firearms branch go away as well. They are reaping what they have sown.

It appears I had made an error earlier, (The April 9th files were actually a typo I had made in my notes, the stuff I had been looking at was actually the 10th)

All the stuff on April 9th was procedural and wasn’t particularly relevant to what we were looking for. All the good stuff is on the 10th. So I’ve rectified the issue. Thankfully I caught it before the film order was placed.

So... This is a little bit of good news, as that is 1.5 hours of film that we don’t have to order.

Here is the correct info, (and yes I double checked)
