Of course they do, and of course they replaced Lakin. But, he shirked his duty to these soldiers to pursue a mindless little legal challenge. His duty to these soldiers takes precedence to this political piece of theater. Soldiers need to attend to their duty and leave the political fights to others.

At least you acknowledge that it is not Lakin's fault for unnecessary suffering because he wasn't there. It is the many people in government who are guilty of and have shirked the oath to the US Constitution that they swore to uphold. Obama the putative president of the United States, as the Commander in Chief, is the source of all military authority. Birthers were told 6 months ago that it would play out like this, and why. Back then, birthers claimed the military court would have to allow discovery, or that Lakin’s conviction would give him ‘standing’, or any of a number of other incorrect ideas.

The first, that a military judge would grant discovery, has been proven false today. That Lakin will gain standing will be proven false soon enough.

Lakin may be a fine doctor, but he wasn’t able to figure out the crowd he fell in with was using him. I ought to feel pity for Lakin, but I don’t. He has been an idiot listening to idiots, and now he’ll pay the price. And pathetic as Lakin is, the people who used him are worse.

The problem that I have with this assertion is that having been elected and sworn in without any challenge to his legitimacy, the only remedy now available is the impeachment process. Those who claim that discovery of his illegitimacy will render his entire Presidency moot are ignoring the Constitutional and legal realities. The Courts can't act, the FBI can't act, Barney Fife can't act. Only the Congress can act on evidence that he is ineligible for the office and that will never happen. Its not a perfect world.

Yes it would be some court knucklehead. The ruling would come from the third branch of government the judiciary as in the Supreme Court. But you're in luck since they can evade the issue for lack of balls.

I appreciate the sentiment, but I can’t envision exactly how this would come to pass. We are talking about the government, after all. Who would bring the criminal action? Who would execute the arrest? Who would adjudicate? What would other government agencies and political goon squads do? Would they stand idly by?

I think that everyone would throw up their hands and say that the Constitution prohibits them from acting and stand by until the Congress decides to do something. There would be a hew and cry from the public, of course, and the press would claim that its only about sex; but nothing would happen until Election Day 2012.
