IIRC, it was CNN’s JOhn Klein who told the whopper that HI had destroyed all paper documents when the elctronic files were begun. Klein even had Lou Dobbs repeat that lie on air. I know it’s a lie because when I heard that i picked up the phone the next day and called the Vital Records department in HI! CNN has no credibility if honesty is the measuring rod.

>Even if these records don’t contain a birth certificate, they certainly contain forms stating Obama was enrolled as a foreign national to qualify for the scholarship money.
Who is taking care of these records? Dollars to donuts the records will turn up missing for unknown reasons.<

The first thing Obama did when he took office was to seal his records under presidential order. Anyone who makes them public does so under penalty of law :-(

So....CNN and others have now superseded the entire judicial system of the United States including the SCOTUS....

I'm calling bullshit! Over my dead body!

Dad said that no lower court will make a ruling knowing he could legally appeal the case and that could take weeks or months. The country would be in turmoil for whatever time it would take internally as well as internationally.

Therefore they will punt it to the SCOTUS who would order action to be taken immediately, without appeal. It's what is best for the nation.

The first thing Obama did when he took office was to seal his records un Anyone who makes them public does so under penalty of law.

That is utter hogwash. We've debunked that birther rumor many times. See my FR home page for the links to the EO's referenced below.

Rumor: Barack Obama's first action as POTUS was to sign an Executive Order sealing all of his records.

Truth: Barack Obama's first Executive Order, 13489, was regarding the release of Presidential Records from the National Archives. The National Archivist does not maintain or administer the State of Hawaii's vital records or any State's university transcripts, which are the records to which birthers want access. Obama's EO 13489 revoked Bush's EO 13233 on Presidential Records, which revoked Reagan's EO 12667 on Presidential Records.

You have ample venom to spew. Now, do you have the guts to ignore the laws signed by Obama, since he isn’t a real President? Or will you just keep hoping the military does it, so you can watch them ruin their lives from the sidelines?

Why don’t you try ignoring the tax laws, and go on public record as doing so. When you get convicted, you’ll have standing - just like you & your friends tell Lakin.

“What I am NOT is stupid enough to fight in a manner where only loss is possible.”

However, sometimes certain battles (legal in this case) may be “lost” yet the war may be ultimately won.

Obama has had beer summits involving a cop and a black professor.

Obama has interposed his opinion as to a Muslim’s right to build a mosque at ground zero.

Now a military officer (and others) requested that he release some of his records that speak to his illegibility to serve as president.

So why didn’t he?

Concerned citizens want to know.

Why doesn’t he just release them to a competent authority — such as a judge?

What’s the big deal?

What is he hiding that is more important than preventing an otherwise honorable man from going to prison?

And — as someone pointed out — a VERY valuable man that could be saving soldiers lives!

Legally, Obama may be “winning” these legal cases but his moral “standing” is despicable!

Americans are watching and I have a hunch they don’t like what they see.

Looks more and more like Obama is going to be a one termer, don’t you think?

I am well aware of the rule he signed.
It is here
http://www.fas.org/sgp/obama/presidential.html

I think you missed my point and after reading all the flaming going on, I really don’t want to get into it with anyone.

What i said stands. He sealed his records under presidential order. It was in fact the first thing he did within his power.

I said nothing about Hawaii, that took care of itself with new regulations and laws.

"Commander David LaRocque: Did you know that Colonel Lakin is being housed in the psychiatric ward at the Walter Reed Army Medical Center pending his court-martial? and that he is being subjected to threats and severe psychological abuse for simply doing what is required of him by his oath of office as a U.S. military officer? This is what they did to dissenters in the Soviet Gulag!"

There was a Russian MiG-25 Foxbat pilot, Viktor Belenko, who defected to the West with his fighter that landed on the Japanese island of Hokkaido in December of 1976. This fighter pilot was one of the top military men that the Soviet Union produced. As I may recall before he defected, he had a run in with the Russian military intelligence called the GRU. He ended up in a hospital psychiatric ward for questioning the Soviet Communist system. He was correct in his questioning and doubting the corrupt Soviet Communist and the apparatchik functionaries. Now we see we are doing the same to prop up corruption that has invaded all forms of federal government.

The two EO’s are not the same in intent.

Pres. Bush

http://frwebgate.access.gpo.gov/cgi-bin/getdoc.cgi?dbname=2001_register&docid=fr05no01-104.pdf

Obama

http://edocket.access.gpo.gov/2009/pdf/E9-1712.pdf

Example - Obama’s:

“Sec. 4. Claim of Executive Privilege by Former President.

(a) Upon receipt of a claim of executive privilege by a
living former President, the Archivist shall consult with
the Attorney General (through the Assistant Attorney
General for the Office of Legal Counsel), the Counsel to
the President, and such other executive agencies as the
Archivist deems appropriate concerning the Archivist’s
determination as to whether to honor the former President’s
claim of privilege or instead to disclose the Presidential
records notwithstanding the claim of privilege.

Any determination under section 3 of this order that
executive privilege shall not be invoked by the incumbent
President shall not prejudice the Archivist’s determination
with respect to the former President’s claim of privilege.

(b) In making the determination referred to in subsection (a) of this section, the Archivist shall abide by any instructions given him by the incumbent President or his designee unless otherwise directed by a final court order.

The Archivist shall notify the incumbent and former Presidents of his determination at least 30 days prior to disclosure of the Presidential records, unless a shorter time period is required in the circumstances set forth
in section 1270.44 of the NARA regulations. Copies of the notice for the incumbent President shall be delivered to the President (through the Counsel to the President) and the Attorney General (through the Assistant Attorney
General for the Office of Legal Counsel). The copy of the notice for the former President shall be delivered to the former President or his designated representative.”

~ ~ ~

President Bush’s

“1) When the former President has requested withholding of the records:

(i) If under the standard set forth in section 4 below, the incumbent President concurs in the former President’s decision to request withholding of records as privileged, the incumbent President shall so inform the former President and the Archivist.

The Archivist shall not permit access to those records by a requester unless and until the incumbent President advises the Archivist that the former President and the incumbent President agree to authorize access to the records or until so ordered by a final and nonappealable court order.

If under the standard set forth in section 4 below, the incumbent President does not concur in the former President’s decision to request withholding of the records as privileged, the incumbent President shall so inform the former President and the Archivist.

Because the former President independently retains the right to assert constitutionally based privileges, the Archivist shall not permit access to the records by a requester unless and until the incumbent President advises the Archivist that the former President and the incumbent President agree to authorize access to the records or until so ordered by a final and nonappealable court order.”

You don’t want to discuss it because you don’t understand it.

The EO has absolutely nothing to do with Obama’s personal records that were created before he became POTUS. The EO affects records he generates as POTUS, which are held in the National Archives.

Additionally, the EO restores the policy to what it was under Reagan. So I guess Reagan sealed his records as part of a conspiracy too?

Because the former President independently retains the right to assert constitutionally based privileges,

He trashes the Constitution and then tries to hide behind its skirts.

Of course they’re not the same. Obama’s EO restored the policy to what it was under Reagan.

If FR took a poll on the eligibility issue, you would find yourself in a very small minority.

Take a poll of Freepers. Ask these questions:

Do you, like Red Steel, want to change the Constitution so that any Democrat Federal Judge can remove any Republican President from Office at any time they want to?

Do you, like Red Steel, want to change the Constitution so that the various branches of the military can remove any Republican President from Office at any time they want to?

Do you, like Red Steel, believe that Birtherism is a failure in court because all three branches of the Federal Government, and all the millions of lawyers in the Country, except Orly, Berg and Kreep, are part of a giant conspiracy?

Do you, like Red Steel, believe that the fact that so many of the Freepers who belittle Birtherism have been Freepers far longer than he has is more proof, not that Birtherism loses on its (lack of) merits, but of a giant conspiracy?

Do you, like Red Steel, believe that Freepers without small children in the house should go to the extra expense of using lead foil, not aluminum foil, to keep out the mind control rays?

Let me know how that turns out.

Committing fraud is crime. People go to jail for it every day.

Well prove Obama committed fraud, get Congress to impeach him and the Senate to convict him, and you've got it made. I'll stay out here on top of my rock to see how well you do.

Naw, the questions should be like this:

Do you like Pilsner want to see abject violations to the US Constitution where there are no checks and balances to correct the abject violations by the judiciary branch of government on the Executive branch, and let the matter go while there is clearly and willful harm being done to the country?

Do you, like Red Steel, believe that Birtherism is a failure in court because all three branches of the Federal Government, and all the millions of lawyers in the Country, except Orly, Berg and Kreep, are part of a giant conspiracy?

Do you like After-Birfer Pilsner believe that Obama should continue to hide his $12 birth certificate from the courts and the American people, and continue to have his mouth pieces in duh liberal press and his Press Secretary Roberta Gibbels misdirect and deceive the public covering and obfuscating for Obama?

Do you, like Red Steel, believe that the fact that so many of the Freepers who belittle Birtherism have been Freepers far longer than he has is more proof, not that Birtherism loses on its (lack of) merits, but of a giant conspiracy?

On the contrary knucklehead. I've been an active FReeper longer than you although not by much. You can ask the management here if you don't believe me. You so want to believe that Obama is a natural born citizen or you do not care, but you care enough to carry Obutt's water here. The accusation has merit except for people who have their heads in the sand.

Do you, like Red Steel, believe that Freepers without small children in the house should go to the extra expense of using lead foil, not aluminum foil, to keep out the mind control rays?

Do you like Pilsner believe that it is a good idea to post comments while being drunk?
