Oregon court rules teeth not considered dangerous weapon in a fight

I see Oregon is really putting some "teeth" into their laws...

Biting your opponent during a brawl may violate the rules of what's considered a fair fight, but it doesn't turn the attack into first-degree assault.

The Oregon Court of Appeals has ruled Wednesday that teeth cannot be considered dangerous weapon in a case that grew out of a 2008 fight between two Marion County men.

During the fight, 30-year-old Scott Russell Kuperus II, clamped down and took out a chunk of his opponent's lower ear. He was arrested and later convicted of first-degree assault and second-degree assault and sentenced to 90-months in prison. His attorney argued the first-degree assault charge was wrong.

I’m a little confused by the variations of “assault” from state to state. THere’s assault, attempted assault, assault&battery, battery, 1st 2nd and 3rd degree assault...

There’s no consistency, or doesn’t seem to be. Is hitting with a rock first degree assault? Is spitting on someone 3rd degree assault? What the heck is battery if it’s not assault? Can you batter someone without assaulting them?

I’m confused also. In Fl, assault is threatening someone. Battery is touching someone. These two can become aggravated if a weapon is used.

I’ve come to the conclusion that the only reason to find yourself in a fight is because it was totally unavoidable, in which case, kill them.

Pretty soon only lawyers will be allowed to fight and even they must have a judge as referee.
