Cable Internet service is shared. In other words, if all your neighbors get online, your service slows down.

Also, keep in mind that the same cable is carrying not only your internet but your TV programming.

The problem is simple to fix - get rid of cable net access. It's the same anywhere - cable gets slooooooow after 8-9 PM, because everyone is getting on the same pipe.

Best remedy - get DSL, (usually a tad more per month in some places, about the same in others) it never bogs down, unless someone else in your house is streaming video while you're trying to surf the net.

Use speedtest.net and begin to document the speeds before and after
9:00 pm.

Only if your A-hole provider oversells their bandwidth.

Funny thing, when I sell to my clients, I can't say well, I'm charging you for 100 pieces, but I've oversold my inventory, so I'm going to give you 80 pieces and still keep your money.

I don't go along with that crap. When the ISP doesn't have the bandwidth to provide the speed it is charging you for, it should be forced to stop selling bandwidth. It's no less robbery than going into a gas station which charges you for 10 gallons and gives you five because it wants to sell gas to everyone even if it doesn't have the gas.

I don't know of any residential Internet service provider that provides access with any sort of SLA, uptime, speed, or otherwise.

If you want an SLA, you're going to have to pony up the bucks for commercial Internet service - and even then, it only covers access within the service provider's network, not bottlenecks in other nearby networks.

I had Comcast cable and Internet and had the same problem. I switched to DSL and haven’t had any more problems.

Yeah, well my jack off provider can't get me 3 megs (provisioned for 10) at 9 pm DIRECTLY TO THEIR SERVER 2 MILES FROM MY HOUSE. They have a speed test that runs directly to their server, not on any other network and I'm pulling 3 megs right now.

They have a bad node in my area and will only check it in the morning when everything is moving at optimum speeds. They refuse to examine at night.

And they are working on offering (that means charging for) 20-30 megs when they know they can't/won't provide 10 right now. I call that theft.

Check your contract with them.

If you have an SLA that guarantees speed, service availability, etc., and the provider refuses to make good on their end of the contract, then it's breach of contract - not theft.

My brother had Comcast wireless. It sucked. He lived less than 1/2 mile from the cell tower and could see if from his bedroom window.
Even pointing the antenna at the tower he couldn’t get more than 3 bars out of 5 any time of the day.
In fact he would see his ping rate go from 60ms to 6000ms in less than 20 seconds all the time.
He had the connection password protected so nobody could piggyback off his connection.

Eventually he switched to Verizon wireless internet. Says it is much faster.

He just wishes he could get RoadRunner where he is living like I have.

You know I don't. The only thing my ISP will guarantee is that I will have my service (such as it is) cut off if I don't pay the bill on time.

Not that the concept is worth anything anymore, but there used to be an understanding that the seller would at least attempt to provide what they were charging for. When I buy a toaster, it is implied that the device will actually toast bread, not just occupy space in my kitchen. Imagine printing on the box that this toaster will toast, but how often it will work, and how well it will work are not known and are not the responsibility of the seller of said toaster. That's internet service.

Buy a bus ticket to downtown, and maybe it takes you there, or maybe it takes you to the west side. Or maybe it takes you halfway there. Your ticket price is always the same, regardless. But that's fair because the bus driver told you it may or may not get there, but you gotta buy the ticket if you want to get on the bus....and hope for the best.

No, I understand what you are saying. Yet in most anything else, contract law assumes an implied warranty for what the product or service is presented to do.

test your speed at various times of the day, keep a log, then confront comcast if a pattern is evident.
