Mark, Rush, Sean Okay, Then What now? - Vanity

I heard Mark Levin last night. I heard Rush Limbaugh today. I am hearing Sean Hannity. They were discussing Obama non-recess appointments. Who else have "you" listened to today? I have been waiting for what is supposed to be done about this situation and is possible I missed something? They have pointed out how wrong it was, unconstitutional etc but okay , what now? That is besides fuming , and getting angry and holding our breathe until November.

In the sense that all the conservatives do is talk, you are correct! The left has acted over the last eighty years. The left controls the media, visual arts and organs of mass communication. The left has infiltrated and controls the education of the youth who then grow up to be leftist. The left has disintegrated our society by forming blocs of voters such as their appeal to members of the Third World and women. The left uses money to purchase power. They shamelessly use pity to sway the mob; i.e. reason rarely prevails over the sight of the soulful eyes of a sick puppy. Social and economic egalitarianism are weapons of the left which guarantees the numerous victories they enjoy.

The result of all the aforementioned being the left is in charge. The only fear the left has is the fear of being unable to consolidate and make permanent their hegemony.

We've been had, are being had, and will continue to be had by these criminals in Congress, WH, the courts, the media, etc., etc. We're all socialists criminals now. We'd have to go back to the anti-federalists (pre-Constitution) to understand how far we've descended. The leviathan marches on.

I work with a mortgage broker, and it's not so trivial when it's your job, or industry, being regulated out of existence.

The reality of the situation is there is nothing to be done immediately. Somethings will eventually get done, when in fact it’s tested in court. Note that not *too* many democrats are sounding off for joy on this. The smart ones know they’ll have to live with this if they let it go.

A President at odds with the lawmakers is bound to break a lot of laws and those chickens will come home to roost on him.

Imagine this: The Elected President isn’t President until certified by the Senate.

"How Long Must the Senate Be in Recess Before a President May Make a Recess Appointment?"

"The Constitution does not specify the length of time that the Senate must be in recess before the President may make a recess appointment. Over the last century, as shorter recesses have become more commonplace, the Department of Justice has offered differing views on this issue. Most recently, in 1993, a Justice Department brief implied that the President may make a recess appointment during a recess of more than three days. On at least three occasions, the Senate has used procedural tools to prevent the occurrence of a recess of more than three days for the stated purpose of preventing such appointments: the 2007 Thanksgiving holiday period, the period between the first and second sessions of the 110th Congress, and the 2008 Presidents Day holiday period. In each of these cases, the Senate {under Harry Reid} met in pro forma sessions (during which no business was to be conducted) every three or four days over the course of what otherwise would have been a longer Senate recess. The President {Bush} made no recess appointments during these periods."

As usually, it's a case of allowing the Democrats to ignore rules that they held the Republicans to, without Republicans making them pay the price.

As I suggested in #12, a less drastic approach that Republicans can take is to first reaffirm that the Congress was NOT in recess, and then state that now that Obama has forwarded his nominees to Congress, confirmation hearings will begin in a few weeks.

Simply treat this "recess" appointment as a forwarding of nominees, and start treating it as business as usual, and not a recess appointment.

If Obama and Reid object, then ask what they're afraid of? Ask them why they don't want Obama's nominee to face a hearing?

Surely that's not too hard for McConnell and Boehner to do?

I would love to see that fight on national TV. Make Obama look like a lawless dictator laughing at the other co-equal branches of government.

You see, this is exactly what I meant by Republicans talking themselves out of action. They start by assuming the following sequence of events, and then behave as if they already happened:

1. Obama forces constitutional crisis.
2. Republicans stand up and challenge Obama.
3. Obama goes on TV and blames Republicans.
4. Republicans say Obama is wrong and he forced this conflict while we are trying to help the middle class.
5. Obama goes on TV and calls Republicans whiney and getting caught up in the weeds.
6. Republicans bicker amongst themselves over what to do next.

So even though Republicans are only at step 2, they assume step 6. Nobody knows what would happen if Republicans actually did step 3. All we know is that Republicans never want to find out because they are afraid to play the game.

The power of Congress of advice and consent is not trivial.
If this precedent of an endless end run around the Congress stands, the President will have unlimited appointment powers. The unapproved appointments will have a limited term but be renewable forever.
This is a test case and a gut check for what is left of the Republican Party.
At this point, the Republican Party is failing and losing what little credibility they have left.
If Mr. Obama can make a ‘recess’ appointment when Congress is not in ‘recess’, can he sign a law of his own drafting without the tiresome bother of sending the bill through the House and Senate?

What now? Probably the same thing congress did to address Obama’s Kenyan Daddy and his dual-birth rights.

Frustration is our burden, as long as we have to rely upon the likes of Boehner & McConnell to get anything done.

Actually, Mark did outline a possible approach. Anyone affected by any and all regulations from this agency can sue based upon the fact that they are acting without authority. Challenge everything they do. Tie them up in court. It’s what they do, after all.

The Obamanunists are using that patented Clinton "depends upon what the meaning of recess is" ploy. It's hopeless to go round and round with that. May even take a court decision -- months from now.

Concentrate on what everyone acknowledges is a czar -- no Constitutional Senate confirmation required. Both parties do it but Obama has gone nuts, it appears -- or rather he has proved that he is nuts.

How many czars does Obama have now? What freedoms have we lost -- especially businessmen and women?

Start talking about how Obama is czar and fettering us.
