Try buying your .223 (or 5.56mm) AR ammo at Walmart (always cheaper than Dick's) or online at cheaperthandirt.com. They have a great selection of everything. Example: Ammo .223 Remington Armscor FMJ 62 Grain 20 Round Box (target /practice ammo) for $7.89. What's more, the company is a huge supporter of Second Amendment rights.

Dick’s is overpriced anyway. This place is pretty good as far as major retailers go, if they are in your area.

The 2A says you have the right to keep and bear arms. It does not say that other citizens are prohibited from checking your citizenship status before selling you the arms or the supplies to use and maintain them.

I then attempted to inform them that just because someone is a non-citizen, does not make them a “prohibited person”, as legal resident aliens are allowed to purchase guns, as well as ammo. This is the next response I received:

Being the kind of person that I am, I went ahead and checked out the BATFE website. On this page, they list the following regarding resident aliens and firearms purchases.

Q: May aliens legally in the United States buy firearms?
An alien legally in the U.S. may acquire firearms if he has a State of residence. An alien has a State of residence only if he is residing in that State and has resided in a State continuously for at least 90 days prior to the purchase. An alien acquiring firearms from a licensee is required to prove both his identity, by presenting a government-issued photo identification, and his residency with substantiating documentation showing that he has resided in the State continuously for the 90-day period prior to the purchase. Examples of qualifying documentation to prove residency include: utility bills, lease agreements, credit card statements, and pay stubs from the purchaser’s place of employment, if such documents include residential addresses.See also Item 5, “Sales to Aliens in the United States,” in the General Information section of this publication.[18 U.S.C. 921, 922(b)(3), (d) and (g), 27 CFR478.11 and 478.99(a)]

Now, firearms and ammunition are two different things, but as far as I know, there are not any laws baring legal resident aliens, who can purchase firearms legally from purchasing ammo to go with those firearms (except for rare circumstances with individuals under the age of 21 who legally possess a handgun, you guys are screwed).In my opinion, this citizenship question is poorly worded. If the wording was changed to something like “Are you legally allowed to purchase ammunition?” nobody would have a problem with it, and of course, nobody would probably answer “No” to that question either.
I totally understand this company not wanting to sell ammo to prohibited persons. Keeping a FFL in good standing, and following all of the laws regarding the sales of firearms, and ammo must be a daunting task for a mom and pop gun shop, and to try and keep everything kosher for a large chain must be mind boggling. However, since we now know that citizenship has nothing to do with whether or not someone is a “prohibited person”, hopefully Dick’s will re-visit this issue, and maybe change the wording of the question as not to keep legal residents from purchasing firearms and ammo.

How is it an infringement if they don’t ask for papers or ID and your purchse goes through regardless of what you ‘tap’? Sounds to me like it’s more of a numbers thing. I haven’t been to Dick’s in a month of Sundays, so exactly what is your beef with this? Do you live in an area where there might be a lot of foreigners? A resort area? Maybe they are trying to get an advertising demographic.

Depends on the right. Do non-citizens who are arrested have 5th amendment rights when going through the criminal justice system? Yes - the 5th amendment is quite clear that “no person” shall be denied those rights. On the other hand, the applicability of Second Amendment rights is much less clear, as “the people” may have a narrower meaning (as in, “we, the people”) in the Second Amendment as “no person” does in the Fifth.

Well, as an FFL Licensee I do my due diligence prior to selling a firearm or ammunition. Here are the laws/regulations that apply:

So you got offended....do you get offended when your bank help line says “Press 1 for Spanish, press to for English?” You sure as hell should be. Asking whether you are a citizen when buying Ammunition to me is a good thing. Frankly, I don’t want foreigners of any flavor “not-citizen” buying anything related to weapons, period...The US Constitution is not for them; it is for citizens. They can go the hell home if they don’t like it.

Export Controls.

It is illegal to export guns or ammunition to countries like North Korea, Iran, China. If you consider some of the more specialized items for sale at stores Dick’s, like high powered scopes or armor piercing bullets, the list of prohibited countries gets a lot longer.

The way that export control laws are now written, selling a prohibited item to a national of a foreign country within the U.S. is considered an “export” of that item. So if Dick’s Sporting Goods sells a rifle and ammunition to an Iranian citizen, they are probably in violation of export control laws. And I am guessing that ATF or other agencies would love to hit a major gun/ammo chain store like Dick’s or Cabela’s or Gander Mountain with huge fines for violating export control rules.

In my opinion at least, your anger is misplaced. Dick’s is just trying to follow the law and stay in business.

Many Constitutional rights apply to citizens and non-citizens alike, for the simple reason that the Constitution (and specifically the bill of rights) does not create or grant rights, but simply protects those rights from intrusion by the government.

It may be the case that the Constitution does not protect certain rights (perhaps even the Second Amendment rights) of non-citizens, but it is not accurate to flatly state that Constitutional rights do not apply to non-citizens.

She asks question A. If the answer is "Yes, I am a citizen," the computer stops there. If the question is "No, I am not a citizen," the computer asks for production of a visa or green card.

We have foreigners who shoot at our club at times. There is no law against foreigners buying ammo nor should there be.

The question was "Are you a US citizen"? Are you getting 'illegals' and 'foreigners' mixed up?

like that question will stop any criminal from getting ammo!

That question should have been asked MORE OFTEN years ago and written in English only!

I know that many of the laws pertaining to my 2nd Amendment rights are unconstitutional. However, do you want to go to Federal prison ignoring those laws? Okay...you’re offended. I can see that. NO, I don’t think Miranda anything applies to foreigners despite what the law says. The “law” misapplied by liberals is why we are even debating this question at all.

Miranda, misconfirmed by the SC to apply to foreigners coupled with all the other feel-good things like illegals’ uncomplicit children ‘deserve consideration’, illegals who have been ‘good’ while they’ve been here illegally, and on and on and on and on are why this country is so effed up right now....

Try complaining about having to endure Spanish radio, or TV, or pressing 1 or whatever. Don’t bitch about having to affirm you’re a citizen.
