In Article 1, Section 8, Clause 11, we find that the Constitution of The United States grants to The Congress the Power To declare war, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water.
What are "Letters of Marque and Reprisal?" From the Free legal dictionary we get the following definition:"LETTER OF MARQUE AND REPRISAL, War. A commission granted by the government to a private individual, to take the property of a foreign state, or of the citizens or subjects of such state, as a reparation for an injury committed by such state, its citizens or subjects."
Which begs the question: How can congress authorize letters of Marque and Reprisal if the there is no privateer with sufficient arms to take the property of a state or its citizens or subject? Clearly the writers believed that the people should be armed to a greater degree than any government forces. Their distrust and justified fear of standing armies was well known.
It is apparent that today the people are under assault by a tyrannical, overarching federal leviathan. The political class fears a backlash by the people as it claims the right to lock up American citizens without any right to counsel or jury trial. Further, the political class has so transmogrified the idea of any right to privacy as to be wholly unrecognizable.
I fear that only possible outcome of the clash between this burgeoning police state and the fond memories of individual freedom will be bloodshed. It is apparent that the political class no longer believes that their authority is granted by our consent. They have become a class unto themselves believing they are out rulers.
I believe that several of the ships that took part in the Tripoli pirates attacks were privateers authorized by Jefferson and his Congress. Now-a-day's, Blackwater comes to mind. Unfortunately they sold out to FedGov.
