Is Ted Cruz a Natural Born Citizen... of Canada?

Ted Cruz was born "Rafael Edward Cruz" December 22, 1970 in Calgary, Alberta, Canada.

His mother is US citizen Eleanor Darragh.

His father is Cuban citizen Rafael B. Cruz. (naturalized as a U.S. citizen in 2005)

Eleanor Darragh and Rafael B. Cruz were residents of Canada for at least four years from 1970, possibly earlier, until 1974. They conducted business there as Rafael B. Cruz and Associates, Ltd.

Where they "permanent residents"?

Is Ted Cruz a "natural born citizen" of Canada?

He wasn’t born IN the US at all.

And that has absolutely nothing to do with anything.

According to “Mr Cruz” himself (his Senate staff spokesman), there are only two types of United States citizens. One, when born, is a citizen. Two, when born, is not a citizen, but later becomes a citizen through the naturalization process.

Mr Cruz himself claims that natural born citizen refers to the first type. The day you are born, you are a citizen. He further states that this is based not on the soil where the citizen mother drops the baby, but the American citizenship of the mother, if she is of age (18 or older).

The second type is not a citizen at birth (natural born), but has to become a citizen by later becoming naturalized. It is this second type that is not eligible to run for president.

We do know (and he knows, of course) that the US has recognized anchor babies in this country - a non citizen crosses the border and gives birth on this soil. That is an aberration of the law. It should be ended. Unfortunately it has not only hurt our sovereignty but it has helped to confuse people like yourself about citizenship law.

When I first heard of this, it occurred to me that this is probably being pushed by the far-left. Once they have established a ‘precedent’ with Cruz, they can put up anyone they want for President.

I was talking about Rubio, but since Cruz’s mother was a US Citizens who owed her alleges to the US, this would make Ted Cruz a US citizens (Natural Born) at birth.

You think he’s gotten this far in life, brilliantly in every way, but needs you to tell him what country he’s a citizen of??

Since US law applies to those US born on US soil wouldn’t Canadian law apply to those born on Canadian soil?

uh no, he is not an anchor baby. His parents were in the US LEGALLY therefore in accordance with the US Constitution, he is nbC whether or not you like it.

There are at least two classes of citizens: Born and naturalized. Anyone born on US soil (and “subject to the jurisdiction thereof,” which excludes foreign diplomats) is a US citizen at birth. Is that the same thing as a natural born citizen? In some legal theories, yes. A citizen at birth is a natural born citizen. All other citizens are naturalized.

Some legal theories recognize a third category, someone who is a citizen at birth but not a natural born citizen. They will quote Vattel and Minor v. Happersett and US v. Wong Kim Ark, which address the question in passing and not as part of the ruling, but SCOTUS has never ruled directly on the question. Some theorize further that only the child of two citizen parents, regardless of location of birth, is a natural born citizen.

Whether Ted Cruz was a citizen at birth, born on foreign soil to one US citizen and one non-citizen parent, would depend on US immigration laws at the time of his birth (and in no way on Canadian citizenship laws). If he was a citizen at birth, whether he was a natural born citizen is an issue that will be debated on Free Republic long after everyone reading this is dead.

Personally I don’t care if he’s from Neptune. He’s only one of several that has the guts and determination to get us back to a republic.

Anchor babies are not just for illegal aliens. Someone here with more knowledge on the subject will fill you in, I’m sure. If you think the Democrats won’t hammer him with this, then I don’t know what to say.

Under English common law, yes he would be. However it is irrelevant. However, since his mother was a US citizens who owed her allegiance to the US, Ted Cruz is Jus Solis.

Ted Cruz is a Natural Born Citizen of North America, but not of any single nation.

Natural Born Citizenship is what you have when parents and child are all citizens of the same nation when and where the child is born.

NBC is the most pure, undiluted form of citizenship, with no competing citizenship claims for or by that child due to the circumstances of his/her birth.

While he is not an NBC of the US, there are other classes of citizenship that apply to Ted Cruz and I am grateful that he is an American citizen who chose to serve us all in the Senate instead of serving only the special interests of a political party or their destructive ideology.

US law governs US citizenship. Canadian law governs Canadian citizenship. Every Jew, regardless of place of birth, is eligible for Israeli citizenship under that country's Law of Return. Anyone with an Irish grandparent is eligible for Irish citizenship. Do those laws affect the US citizenship of the people to whom they apply?
