An Oakland man has been found guilty of first-degree murder for shooting and killing his friend during an alcohol and cocaine-fueled argument over the existence of God.
33-year-old Douglas Yim was also found guilty Tuesday of assault with a firearm and mayhem for shooting a second friend in his living room two years ago.
Yim killed 25-year-old Dzuy Duhn Phan after a night of partying and playing video games. Another friend, Paul Park, testified the two men had engaged in a heated discussion about God.
Yim became enraged and grabbed his gun after Phan asked Yim where God was when Yims father died of a stroke several years earlier.
Yim shot Phan at least six times. Park was also hit by a bullet.
Yim faces 126 years to life in prison.
Well, now one of them knows they were right.

It sounds like one guy taunting another guy over his father's untimely death.
Although—now that I think about it—it would be more accurate to say that one of them (Phan) knows who (Kim) was right.

And another agnostic roommate came home one night complaining about having been at a bar and watching a class mate humble a stripper in the bar in front of everybody. He said that was wrong.
Me: "If there is no God, what's wrong about it?"
Him: "I don't know, I just know it's wrong."
Me: "Maybe you were designed to know that it's wrong."
The dangers of irresponsibility and prolonged adolescence.
Certainly the gun was to blame. Had nothing to do with booze or coke (which king hussein says he did when they could get it) or the person that pulled the trigger.
Mr Phan found out that the guy with the gun will always get the last word.

Interesting. It's like why we are different from animals. A bear will not feel remorse about eating a toddler that wondered from a camp site. We don't blame the mauling of a human on the vicious dog, but its owner or even its breed (race). Still there are some animals that seem to demonstrate emotional feelings when one of their own offspring dies (elephants, etc.).
What makes us special that we know right from wrong? If we are no different than animals, we should not have these moral instincs beyond our own race (humans). But we do.

Sorry, that's not first degree murder.
That's provoked heat of passion under the influence, not premeditation.
So second degree probably, third degree maybe.
But not first.
