A prominent Northern California marine biologist will be sentenced Monday in federal court in San Jose after pleading guilty to illegally feeding killer whales in the wild.
Nancy Black, who runs a popular whale watching tour on Monterey Bay, has pleaded guilty to one count of violating the Marine Mammal Protection Act, a misdemeanor.
Federal prosecutors initially accused Black of feeding orcas in 2004 and 2005 and altering a videotape of her encounters with whales and then lying about it.

None of the clauses in the Constitution’s Section 8 of Article I reasonably indicate that Congress has the power to make laws protecting marine animals.
So what am I overlooking?
And for the record, I think it would probably be a good idea if the states delegated to the feds, via the Constitution, the specific power to protect marine life.
Otherwise, Ms Black may be getting burned by the feds simply because she has probably never been taught about the federal government’s constitutonally limited powers.
An earlier Tyranny, the Third reich, had the most succinct and accurate description of today’s Bureaucratic view of freedom of thought and act on the part of the mere citizen:
“Alles, was nicht erlaubt ist, ist verboten!” - which means
“Everything which is not permitted is forbidden.”
A Bureau-snot in a suit is allowed to tell a noted cetacian expert in a wet suit what is “stressing” a cetacian.
In the Third Reich they had the proper response to such concepts - “Wunderbar!”
Means “wonderful”.
