Illinois Health Officials Shut Down 11-Year-Old's Cupcake Business

Sixth-grader Chloe Stirling learned a tough lesson about government regulation of small businesses, no matter how delicious they are.

The Belleville News-Democrat ran a story about an 11-year-old girl making about $200 a month selling cupcakes that apparently left a bad taste in the mouths of Illinois health officials.

Middle-schooler Chloe Stirling of Troy, Ill., quickly learned a tough lesson about government regulation on small businesses after the story ran on Sunday. Madison County Health Department officials informed her family that the pastry party was over on Monday.

“They called and said they were shutting us down,” said Chloe’s mother, Heather Stirling.

According to the Post-Dispatch, health officials informed the Stirlings that they would have to “buy a bakery or build her a kitchen separate from the one we have” for Chloe to continue selling cupcakes.

“Obviously, we can’t do that,” Heather said. “We’ve already given her a little refrigerator to keep her things in, and her grandparents bought her a stand mixer. But a separate kitchen? Who can do that?”

Chloe was charging $10 for a dozen cupcakes and $2 specialty cupcakes. "I'm saving for a bakery," Chloe said in the piece that got her into trouble.

“The rules are the rules. It’s for the protection of the public health,” said health department spokeswoman Amy Yeager. “The guidelines apply to everyone. People will react how they choose to react. But it is our job.”

Chloe’s mother indicated she would be willing to get the necessary licenses and permits for her middle-schooler to continue operating her small business -- after a tough lesson on government regulation.

And here in Anaheim,Ca, the illegals push their half a$$ed wooden carts and shopping carts filled with bags of ice to make snow cone and sell all sorts of crap and the city doesn't care,

I called to complain about the unsanitary, unlicensed carts and the person at the city blew me off saying that these people were just trying to make a honest living. I asked the person two things, first where did she live and she asked why , I told her so I could send the vendor to her neighborhood. Second I asked her her name and ID number, when she asked why I told her that I was going to cite her as authority for my wife not needing a business license and for my former employer to opt out of both business license and health permit. She hung up on me.

I once knew a woman who was starting a business. She went to the city/county offices and paid the taxes required to get the government’s permission to function...I mean..licenses. She paid it all outright. She was assured that she had paid everything she needed to pay and they failed to inform her that she also needed a food license to put ice in the drinks. So, she opens up and in comes the health inspector to inform her that she can’t sell prepackaged food without a license (like lays potato chips, or doritos, or whatever). And, she can’t use her ice machine, nor can she purchase Ice from a licensed dealer. In fact, she couldn’t even stay open unless she hired someone with a portable foodwagon to sit in her driveway to sell food. And, she still couldn’t put ice in the drinks. It killed her business.

It was crazy.

She did get the food license, but by then word got out and destroyed her customer base.

"The rules are the rules... But it is our job."

Sorry, I was just following orders. It's a common refrain.

"The rules are the rules."

I knew I'd find at least one supporter if I scrolled down far enough.

Yet the illegal Mexicans can sell their homemade tamales in the WalMart parking lot and never get hassled.

I heard this story on radio, last night.
From what I heard this young lady is being shutdown because she does not have required permits.

My questions, why do citizens need permission from govt to fill a need.

These a-holes have forgotten, or need to be reminded of who is paying their salary.

I would include a sarcasm tag except that that would imply that I thought my post was sarcasm.

To anyone reading this post - I am not being sarcastic- govt telling an 11 what she can or cannot sell is abhorrent.

I would urge anyone reading this post to contact the health department, regulating department to back off.

Actually, if there was pot in the cupcakes, they would leave her alone. On the other hand, if she sprinkled the cupcakes with tobacco, she would be in jail by now.

It’s good training for one so young to realize that the state is the enemy.

Agreed.

If the government has time for this, they have too much money and too many people.
