The victim of an attempted Bronx carjacking went berserk Friday, chasing down the thieves and shooting them dead, cops said. The 30-year-old man was driving a Mercedes-Benz SUV when he was approached by Jermaine Johnson and Kaiison Lewis outside the Dyer Avenue Deli Grocery in Wakefield about 4:40 a.m., police said.

If he chased them down and killed them after they were no longer a threat that’s murder my friend, in all 50 states, if he did that he’s not getting railroaded he committed 2 murders pure and simple.
Personally I believe the punks got what they deserved but if he did that he committed murder, period.
If someone is fleeing and you kill them, its murder even in Texas.
Nope, if you hunt someone down after they are no longer a threat that is murder even in Texas and you do not have absolute right to kill to protect property even in Texas. The use of lethal force in defense of even property in Texas is not absolute. Don’t believe me set up a trap that will kill a thief and if it goes off and you are not at the property when it goes off you will indeed enjoy free room and board from the state of Texas.

The victim can reasonably claim not guilty by reason of temporary insanity. Being on the streets at 4 am in Wakefield is certifiably insane to begin with.

I agree with you. It apparently was definitely murder BUT I would never vote to convict him and from the small sampling of ‘typical NY’ers’ in the ‘letters to editor’, they will have a rough time finding anyone in that crowd.
Like it has been said “Some People just need killing” - or something like that....
Course he could always say ‘they’ stole his gun and he ran them down, got it back and killed them before they could use it on someone else..
