A Tennessee man has filed a $1 million lawsuit Thursday against Red Lobster and one of its waitresses after the waitress claimed last year that he wrote a racial slur on a tip receipt.
Last September, the waitress, Toni Jenkins, posted a picture on Facebook of the receipt which had the words “none” and “Nigger” scrawled on it.
Jenkins, who is black, claimed that a white patron had written the slur.
The name and signature of that patron, Devin Barnes, were visible on the receipt.
But Barnes denied writing the epithet. He said he was out to dinner with his wife at the seafood chain’s Cool Springs, Tenn. location.

Even if the patron gets a judgment against the waiter, the waiter will never pay it. Their kind never do.

Yes. The new owner is a private holding company that owns some other restaurants. AFAIK, Red Lobster will continue on.

Anyone who makes a false accusation must get the same penalty that the falsely-accused one would have gotten.
Red Lobster is responsible/liable for what their employees do while on duty at the restaurant.
If the company had decent management with any stones, they would have fired the girl, publicly apologized to the victim and offered him a settlement for the damages caused. As I recall the man was also the recipient of numerous death threats and such.
If there was any legal equality in the justice system, this girl would be getting charged by the feds for a racial hate crime that seriously threatened an innocent person’s well being. The crime was committed against him because of his race. She certainly wouldn’t have done it against a black man.

Great. People reporting fake hate crimes are the ones committing the hate crime.
Even if it had been true it is not illegal to write what was supposedly written on the receipt.
There was no threat in the statement, so there would have been no punishment.
There is probably noting illegal about what the waitress did either. Maybe libel because the patrons name was shown. But you’d have to prove that she intentionally libeled that particular person. She probably didn’t. She probably didn’t care whose receipt she wrote that on, it could have been anybody. So there would be no case there either.
Unfortunately for her and RL she chose a person who is willing to fight back. Most people probably wouldn’t have bothered. Yeah for him!
I hope that woman gets some kind of punishment but I doubt she will.
There is so much bearing false witness going on these days ... there needs to be some repercussions from doing it.
My take is the same as yours. People should “get over it”. This should’ve been a non-issue from the beginning.
I’d be satisfied if she were never able to work in a job dealing with the public for the rest of her life. Oh, and a massive public retraction in all the state’s media for a year or two. Paid for by her, not Red Lobster. Far as I can see the only thing they did wrong here was to hire her.
You beat me to it. Correct. Sue Red Lobster and they/their insurance company can sue their employee. Good luck collecting $1 million from her, though.
They will settle this quickly and quietly.
A guy I work with was at a diner in the city and waiting for his order to be called. The manager came to the front with a bag and was calling for “White” for a while before Joe realized he was the only white person in the place and that was probably his order. Sure enough on his receipt instead of a name it said “white”.
Only person white in the whole place? Where was he?
