Criminalizing America: System Error

Watch this entrepreneur explain how he was targeted and raided by the federal government for breaking a law, despite language in the law that explicitly said he was acting legally.

Bradford Councilman had a business, Interloc, Inc., that utilized an internet database for customers to upload their inventory of rare and out-of-print books while other customers could search the database for books they could not find elsewhere.

One day, armed federal agents burst into Councilman’s office and forced him to wait while they searched the premises. The government charged him with creating a separate copy of an email every time he made a purchase, despite the law saying that, as an internet service provider, he was allowed to do so. After six years of appeals, Councilman was finally acquitted of his charges, but significant damage to his life had already been done.

Some companies I was dealing with in the early 90’s told me they could not use my outsourcing services because the IRS had in some cases seized their accounts and in other cases threatened to seize their accounts. The IRS forced these companies (all under $4 million in income) to sign a contract stating they would only hire full time employees to do their work and not contractors. This contract was because there was no law stating companies could not outsource labor. (This may be one reason that many of these companies went overseas.) The IRS, using tactics that would have gotten the Mafia RICO’d out of existence, can get away with anything. If they seize your accounts, most businesses would have to close their doors immediately. That’s the way our government works now; criminals with credentials.

Disgusting. Only thing that will stop this is to obtain the names, photos, and addresses of whoever decided to launch this raid and make them feel the same fear.
Also those who participated in the raid wearing military gear instead of business suits.

I wouldn't be surprised if there is another law that required him to retain those same emails he was charged with temporarily retraining and he could have been prosecuted for deletion if the government wanted to. (just imagine AT&T or Google telling the NSA when presented with a FISA warrant that they deleted all emails immediately when deleted by the customer).

And its a sure bet that his business was reported by a better connected competitor who has learned to use the government gunmen in lieu of honest competition. The government isn’t smart enough to figure this out on their own.
Id like to know exactly how he appeared on their radar screen in the first place.

This guy was held up for the better part of a decade because of this trial —
here's an idea for an amendment that would solve this sort of injustice, check out sec. 4 in particular:

Judicial Reform Amendment
Section I
No court or tribunal shall deny inquiry into its jurisdiction or the authority under which it operates; any misrepresentation thereof shall result in the judge and all staff being vacated from their offices and charged with malfeasance.

Section II
The Constitution may always be used as a defense, the interpretation presented may or may not be correct but the court cannot prevent it from being cited.

Section III
The Fifth amendment’s prohibition against being tried for the same offence twice is hereby recognized as applying to the offense and not the jurisdiction; therefore no federal case shall be made against a person for actions already tried by the state or subdivision thereof. However, nothing is to prevent a State from trying persons for Treason against their own sovereignty.

Section IV
The Sixth amendment’s guarantee of a speedy trial is hereby recognized: for every week after the six months from the start of the trial the accused shall be paid the national average wage for one week’s pay, this payment shall be the responsibility and liability of the officers of the court.

Section V
The Eighth amendment is hereby recognized as preventing excessively long imprisonment: no term of imprisonment shall exceed ten years. The Eighth amendment shall not be held to prevent capital punishment.

Section VI
The Second amendment is hereby recognized: no court shall bar a juror from wearing his weapon, as he is a free man.

Section VII
The text of the Constitution should not be arbitrarily reinterpreted and, as the judiciary does such with its doctrine of incorporation, the Fourteenth amendment is hereby repealed.

Yeah, silly me — thinking that the Constitution was meant to be read and understood by the general population.
