Pelosi blasts House Republicans over lawsuit to halt proxy voting: 'Sad stunt'

Speaker Nancy Pelosi (D-Calif.) late Tuesday dismissed a lawsuit from House Republicans seeking to block the chamber from holding proxy voting, in which members vote for colleagues remotely on the House floor.

Pelosi issued a statement calling the lawsuit a "sad stunt" aimed at distracting from new efforts for an additional relief bill amid the coronavirus pandemic.

"The House made its will clear two weeks ago when it voted to implement remote voting by proxy and other necessary measures to ensure that Congress can continue to protect lives and livelihoods," Pelosi said in a statement.

"The House's position that remote voting by proxy during a pandemic is fully consistent with the Constitution is supported by expert legal analyses. Further, the Supreme Court made clear over a century ago that the Constitution empowers each chamber of Congress to set its own procedural rules," she added.

House Republicans filed a lawsuit earlier Tuesday seeking to thwart the use of proxy voting. A rules change allowing the remote voting was approved along party lines earlier this month.

Republicans have for weeks fiercely criticized the effort, with House Minority Leader Kevin McCarthy (R-Calif.) dubbing it an "unconstitutional proxy voting scheme."

I would say this...if this is legal. Once you sign your proxy over to Nancy...why should I pay you to be some House Representative? You can come home...back to our district. Same for your staff....no need for them...they can go apply for other jobs, and move on.

No member of the House is supposed to be more powerful or less powerful than the next guy. That was the whole intended purpose. The Speaker job was simply to ensure chaos didn’t reign within the hall. We seem to have lost track of what people are there for.

Yes there is. It's call PRECEDENT.

Liberals love precedent because once they establish precedent they consider it an intractable rule.

That's why immigration is a tangled mess. Most laws have been supplanted by precedent.

Sure we have actual laws to control immigration but precedent has twisted those laws until they can be bypassed by claiming precedent.

That's why we have to keep going to the courts to challenge precedents and re-establish the actual rules of law.

Numerous bills of thousands of pages will no longer carry even the pretense of being the product of the will of the people through their elected representatives. Now the nation will be governed by an ever shrinking, increasingly remote, proxy bearing congressional elite who will hand the administration of government over to unaccountable bureaucrats, after they have taken their vig, of course.

The actions of these unaccountable people, assuming they can get past a Republican Senate and a Republican president, will be subject to review by an unelected, unaccountable and increasingly politicized judiciary. If the Democrats take the Senate and the White House, the Supreme Court then becomes the only institution to protect the people. If the Democrats take the Senate and the White House, can we believe they will leave the Supreme Court alone?

Our federal system has become perverse. The federal government overreaches especially as it distorts the commerce clause while the judiciary condones. The state governments overreach in the chaos of the virus to radically rob the people of liberties, often without rational or scientific justification. In other words, the federal government is active where it should be restrained and states, in containing the virus or in creating sanctuaries against immigration controls, have undermined constitutional and representative rule.

In other words, our constitutional system is spinning out of control.

The prospects for setting the ship of state on a true course are bleak. If Donald Trump is not reelected, game over. If Donald Trump is elected, after him the deluge. No matter who inherits the White House, an economic downturn of severe proportions which might well occur as a result of the government shutting down the economy will make it difficult to turn the people away from the seductions of a tyrant. Virtually no institution in America is willing to risk its existence on behalf of constitutional liberty. The principles of the First Amendment have been done away with in social media and might well go the same way by government action. The people have rightly lost confidence in our government institutions beginning with the FBI and extending right through the CDC.

In short, there is little fundamental underpinning to which the people can rally on behalf of constitutional liberty. What little remains is under existential threat and Nancy Pelosi is only a prominent figure.

It all begs questions....which aren’t written in any form.

If a House member does a proxy to Pelosi...then passes away, can Pelosi continue to vote with that proxy until a new guy arrives from the state?

If a House member does a proxy and decides to hand it to Jay Leno to be in the House and use the proxy vote...is that legal? Could you have a 13-year-old kid receive the proxy and sit for a day as a proxy-House member?

It just seems like it opens up a big Pandoras Box, with no limitations.

What if Nancy Pelosi passes away in the middle of some critical vote, with 99-percent of Democratic House members sitting in their home patio instead of the House floor...could the Republicans carry a measure because the proxy votes were only identified to Pelosi herself?

It just sounds like something you’d do in Paraguay.

Saw McCarthy trashing this by saying that she is just trying to augment her power with this. He did not really explain though why it would increase Pelosi’s power. Anyone care to explain?

We are pretty much there now. You did forget to mention that most of these bills aren’t even written by actual Congresscritters. They’re written by lobbyists who deliver them to Congress where the name of a Critter or two is stamped on it.

Thank you Wickard v Filburn. That decision needs to be reviewed and thrown out entirely.
