Feinstein hits back at criticism over Senate absence, provides no timetable for return (NYT calls for resignation)

Sen. Dianne Feinstein (D-CA) released a statement Thursday pushing back on suggestions that her absence has stalled President Joe Biden’s judicial nominations and made no mention of when she might return to the Senate.

The 89-year-old senator, who has been absent from the Senate since March when she was hospitalized with shingles, said in a statement “there has been no slowdown” on judicial confirmations with her gone.

“The Senate continues to swiftly confirm highly qualified individuals to the federal judiciary, including seven more judicial nominees who were confirmed this week,” she said in the statement.

Feinstein sits on the Senate Judiciary Committee, which is tasked with vetting the president’s judicial nominees before they go to the Senate floor for full confirmation. The statement points out that the committee has advanced eight district and circuit court nominees in her absence.

But, without Feinstein present, the committee is evenly split between Republicans and Democrats, and with nominees needing a majority to make it out of the committee and onto the Senate floor for full confirmation, those who would garner no Republican support currently sit in limbo.

“While the Senate Judiciary Committee has advanced eight strong nominees during my absence, I’m disappointed that Republicans on the committee are blocking a few from moving forward,” she said.

In the statement, Feinstein did say she is “confident” that when she returns to the Senate, they will be able to advance the remaining judicial nominees. Still, she provided no timetable for her return.

Party over person. That’s the democrat motto. They need her to resign so her replacement can be appointed as soon as possible.

With Manchin pissed at Biden, Feinstein’s vote is more important than ever. Although thus far, Lindsey Graham is filling Feinstein’s role on the Judiciary Committee that doesn’t help the nominees in winning a full Congressional vote.

Is it possible that this is ‘timed’...so she leaves, then Gov Newsom appoints Harris back into the seat, and then Biden selects a new VP (Newsom), to be approved via the Senate, and VP Harris providing the tie-breaking vote?

That’s an interesting scenario. It would solve the pesky problem as to what to do with Harris and move Newsom into the prime candidate spot for 2024.

I question if this was directly from Feinstein, or a statement from her staff. Her cognitive capacity has been in question recently.

That’s an interesting hypothetical. But I can’t imagine VP Harris going for it. She is sooo close to making history, and having it all. Why give that up to be just 1 of 100 senators?

Harris stepping aside in return for a Supreme Court seat, I could see that happening.

I worked for New York State. You were only allowed so many absences within a certain period of time. Anything over that, you received a written warning. Three warnings, and you could be terminated. You were only allowed a specific period of time to be absent from your job. You had to have a doctor’s note to cover you for the period you were expected to be out, and the doctor had to provide a date when he/she thought you would be able to return to work. You could not return to work unless the doctor said you were 100% fit for duty. If you had a serious injury, or illness, that kept you out of work for a year, you were immediately given a disability termination.
