FED COURT ACCEPTS WEIN CHALLENGE

Staten Island, NY. - The federal Court yesterday afternoon issued an Order to Show Cause against the state Board of Elections why Republican primary challenger, Louis de la Guardia Wein, should not be on the ballot for the scheduled September 10, 2002 Republican primary election.

"This is the first victory in a series of victories that will make Governor George E. Pataki eat his hypocritical words of working for fair, free and open elections" Wein said. The Order to Show Cause and grant injunctive relief is based on charges that the Board of Elections and the NYS Legislature conspired to violate voters' and the candidate's constitutionally-protected Rights of speech, association and petition. They also conspired to abuse and infringe voters' and all candidates' rights to equal protection of the laws and due process. Judge J. Trager of the United States Court, Eastern District of New York, signed the Order for a hearing scheduled for August 26, 2002.

"This is a first-step in a process that will break the stranglehold that self-serving, career politicians have over the people", Wein said. "It's about time that the people, as in our constitutional 'We, the People', take back our government and put an end to the phony-baloney that comes out of career politicians mouths who are really only interested in how much money and retirement benefits they can steal for themselves from the people", Wein continued.

Wein's broad-based attack focuses on several complaints:

Threats of arrest, harassment, intimidation and infringement of constitutionally-protected rights of voters and citizens to freedom of political speech, association, assembly and the right to petition the government

The avoidable delay of the petition calendar, due solely to the capriciousness of petty political squabbling and purely partisan interests that substantially interfered with Plaintiff's equal protection of the law and due process rights;

The cloak of legitimacy, hiding the purely partisan political interests of the Republican and Democratic leadership of the state masquerading as the legitimate, non-discriminatory regulatory authority of the state; The prima facie unfair and discriminatory standards for ballot access faced by party primary challengers to the hegemony of the Republican and Democratic political and legislative leaders;

The discriminatory dual system of ballot access for Pr! esidential primary challengers and non-federal statewide candidates in which a Republican Presidential primary candidate only needs 5,000 signatures while a Republican challenger to the Governor needs 15,000; and, Tthe arbitrary and burdensome administrative requirement for non-federal statewide primary candidates to conform their petition sheets with schedules detailing the line and page numbers of petition signatures by federal congressional districts that only serves to unconstitutionally restrict ballot access to those who threaten the political status quo.

"I am in this for the long haul. At 61 years of age, I don't need this for my ego. The insanity of political control over our lives is gone to far", Wein said in pointing out that they even want to stop smoking on beaches, in bars and on the street. "Give us a break", Wein sighed.

A conservative, pro-gun, pro-life, true Reoublican couldn't get elected to pick up trash in New York.

The only thing a conservative, pro-gun, pro-life, true Republican candidate could do in New York is elect a very liberal Democrat to the Governors job.

What is the difference between Bill Clinton and the typical New York voter? Bill Clinton is more conservative than the typical New York Voter.

To All you political wizards of New York who are afraid of a Democrat in the governors mansion. If Pataki loses we get our Republican Senate back which will allow us to stop the Liberal agenda that has been moving through New York State. A quick picture of how the three bodies in NY are aligned. The NYS Senate is Republican by nearly a two to one margin, the Assembly is Democrat by nearly a two to one margin. The Governor is a wolf in sheep’s clothing! He pushes a Liberal and anti-gun agenda and campaigns with the Democrats. He is the highest ranking member of the Republican Party which gives him the ultimate control over the Republican Senate. How else do you think he has been able to force through the anti-gun bills he has. Cuomo was not able to get through less restrictive bills in his entire tenure.

Which is better: ??

A Democrat Governor + a Republican Senate + a Democrat Assembly = GRIDLOCK.

Or

A Republican Senate + a Democrat Assembly + a Liberal Republican Governor (Pataki) with control over the Republican Senate = MORE GUN CONTROL LAWS.

A good example of this is Bush and the Democrat Senate.
