Home invasion victim charged with firearm violation -- Wilmette, IL

A Wilmette homeowner who shot and wounded an intruder was charged today with violating the north suburb's ordinance banning handgun ownership.

If convicted, Hale DeMar, 54, faces a fine of up to $750.

"It would be unfortunate and potentially tragic to conclude from this incident that Wilmette families would be safer if they keep a handgun in their homes," Wilmette Police Chief George Carpenter said in a written statement. "The oppose it is true. Wilmette families are in greater danger if they keep a handgun at home."

Hmmm...Chicago Police say that a victim is more at risk by having the means to defend themselves.

Were THESE people safer by relying on the damned Chicago POLICE Department?!?!

UNder IL constitution, the ban would be upheld. In the 1970 debates they specifically mentioned that the state retains the right to ban pistols.

I can't think of a better 2nd Amendment case right now. Even though it is only an ordinance violation.

FYI - he was also charged with violating the lovely FOID act - Firearms Ownership ID. That is a Class A misdemeanor.

Police Chief Carpenter is right.

Only the police need handguns. Civilians have no need for them. The police can do all the protecting.

Wilmette's Police Chief George Carpenter in an idiot. I'd advise the victim to fight it and let the prosecution argue to a jury he wasn't entitled to defend his home and family. Its more than the $750 fine here; its the principle a man's home is his castle. Heck, this is kind of case defense lawyers love.
