Police fear five empty suitcases left at Penn Station, New York FBI headquarters and other security hot spots in early April were a test by terrorists bent on a Madrid-type attack on commuter rails, The Post has learned.
A confidential Metropolitan Transit Authority police bulletin, titled "Possible Surveillance Testing Tactics," reveals K-9 cops are on edge over a "suspicious packages pattern" they encountered between the last week of March and the first week of April.

I don't think a derelict would leave an empty suitcase. Seems silly for a terrorist to do so anyway, why wouldn't you put something in it.
I was on the ferry between Jersey City and NYC about a year after 9/11 (I guess it was). The ferry left right from where the WTC used to be. There was an unattended back pack found, the passengers actually said "Throw it overboard" but the conductor (whatever you call the conducter on a boat! I don't know) didn't. When we got to the Jersey side there was a fellow there to claim it. Lucky him it didn't get tossed, all thanks to the conductor. I still think it should have been tossed.

At Penn Station, a beat-up suitcase was found in the main waiting room at 9:40 a.m. on April 1, sources said. So... somebody left a beat-up empty suitcase in a train waiting room.
Most suitcases that are of no longer use are usually emptied before discarding or even abandoning.
