since they had left his home when he shot them, I'm concerned the DA may decide to file charges against them. What do you think? Was that legal?

In Texas it is legal after dark to chase them down, shoot them in the back, run over them, whatever it takes, on your property or off.

The deceased is now a "victim of violence" and maybe one of the 13 chilren a day who die from gun violence.

Wow, I didn't know they had such a law in TX. I'm amazed. In this case, if the perps didn't have any of the guys property and the owner wanted to get away with it, could he just throw some of his property out in the field and claim the perps stole it?

Close but wrong. It is permitted to use deadly force after dark to stop the commission of a variety of crimes or to retrieve your stolen property if you have no other way of getting it back. However, once these criminals fled with nothing, they were no longer committing a crime. It could go either way with the DA before he passes it to a grand jury. A Grand Jury will hear the case, as in all Texas shootings.

I hope they get it without a charge from the DA and proceed to no-bill (issue no charge). We'll see.
