Serial killers are nearly always men (93%). Furthermore, of the relatively few female serial killers, one third of them worked in partnership with males. Also, it should be noted that many of the homosexual serial killers on this list were not active members of the Gay & Lesbian cultural community. Some homosexual serial killers were openly gay or lesbian. Some were closeted homosexuals. Homosexual serial killers have most frequently chosen young boys or gay men as their victims, although some have victimized females as well. Most of the killers have raped their victims either before or after killing them, although in some cases they have killed after consensual homosexual sex. There have been heterosexual serial killers who have targeted gay victims (e.g., Colin Ireland), but this is very rare.
Well that's just great. Yesterday I received notice of jury duty in the Evansville court. At least it won't be for his trial although that would be a quick & easy verdict.
Actually, the court made this the law by a 4-3 majority.
I am sure we will soon see libs complaining about THIS
close vote(sarcasm).
DOMA (Defense of Marriage Act) allows states to not recognize other states' gay marriages, but the Constitution's full faith and credit clause (as well as substantive due process and equal protection clauses) in the hands of liberal activist federal judges could easily knock DOMA out of the water.
US is mistaken in his assertion. The DOMA was passed pursuant to the powers accorded to Congress by the FFCC. That clause, in its entirety, states:
"Full faith and credit shall be given in each state to the public acts, records, and judicial proceedings of every other state. And the Congress may by general laws prescribe the manner in which such acts, records, and proceedings shall be proved, and the effect thereof."
According to this clause, Congress may pass laws prescribing the effect of one state's "acts, records, and proceedings" in another state. Knowing this, consider the language of the DOMA, as codified in 28 U.S.C. 1738C (2004):
"No State...shall be required to give effect to any public act, record, or judicial proceeding of any other State...respecting a relationship between persons of the same sex that is treated as a marriage under the laws of such other State...or a right or claim arising from such relationship."
Obviously the language of the DOMA tracks the language of the FFCC quite closely. It makes clear that states cannot be required to recognize any relationship treated like a marriage, as well as any claims that might arise from such relationship. You would be hard pressed to find a lawyer or judge who could reasonably argue that this is subject to any other interpretation or, for that matter contrary to law. Suffice to say, there is no risk that other states will be forced to accept the legality of gay marriages conducted in Massachusetts.
This does not, of course, address the issue of whether the original MA opinion, Goodridge v. Dep't of Public Health, will have any persuasive effect on other states taking up this issue. That depends, primarily, on each state court's approach to rational basis review of equal protection claims. In the MA case, the court decided that of the three rationales the state legislature provided for outlawing gay marriage, two applied equally to gay and straight couples, and the third - ensuring a favorable setting for procreation - was meaningless. According to the court, because the state does not test for licensee's fertility, it could not reasonably argue that marriage is about procreation.
It's hard to say whether other state courts will find the MA court's reasoning persuasive or not. Really, it depends on what rationales the state legislatures present for outlawing gay marriage, whether or not they actually do relate to a rational state interest and, ultimately, whether each state's jurisprudence has created a "toothless" or an "effective" rational basis standard.
Cheers!
Everett Volk
I would hope that courts would construe the FFCC as you do to uphold the DOMA. However, I wouldn't put it past a determined activist judge to construe "manner" and "effect" to mean tinkering around the edges, not preventing an act of a state from having no effect.
