Geragos deconstructs prosecution's case against Peterson

Defense attorney: Fetus was born full-term therefore defendant's not responsible for murders

By Jason Dearen, STAFF WRITER

REDWOOD CITY -- Scott Peterson is a cad not a killer, his defense attorney said Wednesday as he began an assault on the very essence of the evidence against Peterson -- when his wife and child died.

In the scenario cast by attorney Mark Geragos, the child was born alive weeks after Christmas Eve 2002, the date prosecutors say his mother, Laci Peterson, had been killed.

"If this baby was born alive, clearly Scott Peterson had nothing to do with this murder," Geragos explained to the six men and six women of the jury. .......

Peterson's lawyer attacks investigators' work

By Brian Anderson

CONTRA COSTA TIMES

REDWOOD CITY - Saying Scott Peterson was "stone-cold innocent," defense attorney Mark Geragos blasted the police detectives Wednesday who investigated the murder of Laci Peterson and the thin case he said they cobbled together against her husband.

In his first chance to lay out his side of the case, Geragos said Modesto police believed early on that Peterson had something to do with his wife's Dec. 24, 2002, disappearance and they worked to prove only that. Through slipshod detective work, lies and far-fetched theories, they built a laughable case from circumstantial evidence that led to the prosecution of an innocent man, he said.

"The evidence is going to show beyond any doubt that not only is Scott Peterson not guilty.""......

REDWOOD CITY -- The same gravity that is holding together the "12 galaxies" apparently had enough pull to draw San Francisco's eccentric sign-toting icon, Frank Chiu, and others looking for a little collateral publicity, to the Redwood City Courthouse on Tuesday for the start of the Scott Peterson murder trial.

Parked near the courthouse in a van covered with biblical and anti-abortion messages, Ronald Brock of San Diego sought attention for his message that killing an unborn child, through abortion or any other means, is a crime.

"Murder is murder, give Conner justice," read a banner on the van. Conner was the name Scott and Laci Peterson planned to give their unborn child before a pregnant Laci disappeared in late 2002. Her husband is facing two counts of murder for their deaths.".....

Geragos: Peterson didn't do it

1:23 p.m., PDT: REDWOOD CITY - Scott Peterson had nothing to do with his pregnant wife’s murder - and his legal team will prove it, defense attorney Mark Geragos declared dramatically this morning during his opening statement.

“The evidence is going to show clearly, beyond any doubt, that not only was Scott not guilty, but stone-cold innocent,” Geragos told jurors.

Peterson, 31, of Modesto, came under media and police scrutiny after Laci Peterson vanished Dec. 24, 2002. But Peterson had no opportunity to kill her and their unborn son, Conner, Geragos said.

Evidence will show the baby was born alive, the Los Angeles lawyer announced in a series of revelations. They include:

Laci Peterson knew that her husband bought a fishing boat shortly before she vanished - and “was in the boat Dec. 20.”

The Petersons didn’t talk about the boat, even during......

I'm not talking about Scott Peterson. I'm talking about all of the nasty comments about Peterson's parents.

I also seem to recall that the Peterson and Rocha families were quite close before the Amber appearance.

Yes, I like Beth Karas too. I watched her earlier and she seemed bewildered by the Petersons behavior - said it was like they were at a prep rally.

The Petersons and the Rochas were close until the Petersons decided that they didn't want the Rochas in "their house" near Laci's things.

For future reference (and additions):

09:30AM The time that Scott said he left home.
09:39AM Kristin Reeve drove by the Peterson home and observed both vehicles in the Peterson driveway.
10:08AM Scott made a cell phone call from the Covena area, while he was on his way to his warehouse.
10:18AM Karen Servas placed the dog McKenzie in the Peterson backyard.
12:54PM Time stamp on purchased Berkeley Marina Launch Area Ticket
02:12PM First cell phone call Scott made when leaving the Berkeley Marina "after fishing."
03:52PM Cell phone call from Livermore, 50 miles from home, and still needing to drop the boat off at the warehouse..
04:30PM The time that Scott said he arrived home.
05:05PM Karen Servas leaves home and notes that Scott's truck is not yet in the Peterson's driveway
05:20PM Scott phoned Sharon Rocha to say "Laci's Missing."

Scott could have left the Covena home as late as 10:06AM, and gotten to the point where the 10:08AM call transitioned to the downtown cell tower. Hoping the time of meringue mention establishes another time point.

To launch the boat, motor out, fish, motor back, get the boat out of the water and leave (because it was raining he says, but the weather people say different.)

(Just wish I could remember what it was that she said that made him say that, it was just some comment or other that she made though.)

This snip is from the transcripts that I posted at the beginning of today's thread of the video clip and Abrams comments...

(COMMERCIAL BREAK)

(BEGIN VIDEO CLIP)

JACKIE PETERSON, SCOTT PETERSON‘S MOTHER: He‘s doing fine. They‘re very nice. The facilities are nice here, and it‘s very humane.

(END VIDEO CLIP)

ABRAMS: I don‘t care what you think about this case, that Jackie Peterson is a lovely woman. That‘s the mother of Scott Peterson standing by her son who is facing trial. And we have been covering the opening statements in that case, Mark Geragos, defense attorney, getting his opportunity today and get this. Today Mark Geragos suggesting that all those tape-recorded conversations between girlfriend Amber Frey and Scott Peterson actually may help the defense in this case, because he talks lovingly about Laci and says he hopes to find her. http://www.msnbc.msn.com/id/5129184/

Dave, how long would it take to launch that boat, get out to where he went, go back in and get it back on the trailer?

Perhaps Dr. Lee will bring his KETCHUP BOTTLE with him again this time, eh?

What an absolute fool!

I started to intensely dislike Henry Lee during the OJ trial and my opinion has only deteriorated since. I hate that they drip praise all over him as if he's some kind of scientific genius.

I think he is an "expert" prostitute and all he cares about is who has the fattest wallet or where he can get the most exposure. Despicable man, IMO.

I don't know.
Pulling a boat and all
and there's traffic in CA.

He managed to cement the body pretty well,
but he sure didn't think thru his story or
time line.

And who did he call?
Their home telephone?
Did he leave a message I wonder?

From Livermore to Modesto you have to go over Altamont pass. It's a four lane highway, but you have to go up an incline, and back down the other side. Hauling a boat would make it slower.

Did they check the fuel capacity/efficiency of the boat? Could possibly determine the distance of the excursion. Water conditions may determine the speed.
