The truth about 9/11 and the war in Iraq, that is the subject of this evening's "Talking Points Memo." In just a few moments, we'll talk with the two men in charge of the commission, but here are the report highlights:

• Presidents Clinton and Bush were not guilty of anything but failing to perceive the extent of the Al Qaeda (search ) threat.

• The CIA (search) and FBI (search) were incapable of stopping the attack because of chaos inside those agencies.

• The CIA didn't have good enough intelligence on the ground.

• And the FBI big shots didn't listen to their field agents.

Saddam did have a relationship with Bin Laden, but did not assist him in the 9/11 attack. Those are the headlines. And the committee recommends a new terror czar, approved by the Senate and reporting directly to the president, and much more intense high tech surveillance of U.S. ports of entry and terror suspects.

Now ideologues on both sides will spin the report. But "Talking points" believes it should be left alone.

Very simply, the commission did an excellent job. Page 66 of the 567-page report caught my eye. And it says, "In July [1998], an Iraqi delegation traveled to Afghanistan to meet first with the Taliban and then with bin Laden...Similar meetings between Iraqi officials and bin Laden — or his aides may have occurred in 1999 during a period of some reported strains with the Taliban. According to the reporting, Iraqi officials offered bin Laden a safe haven in Iraq. But to date, we have seen no evidence that these or earlier contacts ever developed into a collaborative operational relationship, nor have we seen evidence indicating that Iraq cooperated with Al Qaeda in developing or carrying out any attacks against the United States."

So put yourself in President Bush's position. According to the Senate investigation, Lord Butler's British investigation and Vladimir Putin, the intelligence assessments on Iraqi WMDs all said Saddam had them. That, of course, turned to be faulty, at least for now.

But Bush and Blair were told the WMDs were inside Iraq. They were also being told that Saddam had a relationship with bin Laden. Do the math. Would you, as president, let that scenario play out while the U.N. dithered around?

What if Saddam Hussein did have anthrax, gave it to Al Qaeda, and a month later San Francisco was attacked? What if President Bush had ignored the intel and a disaster took place? Well, you know the answer. Mr. Bush would have been driven from office and gone down in history as a villain.

Any fair-minded person knows that the president had to act. The remaining legitimate questions concerned the timing and the planning of the Iraq action.

So there you have it — truth is always a good thing.

And that's "The Memo."

Hating America. That is the subject of this evening's "Talking Points Memo." According to a new poll, 40 percent of Canadian teenagers think America is an evil country. Among French-Canadian teens, the number jumps to 64 percent. Those numbers can be laid right on the doorstep of the Canadian media and government

As you may know, the FOX News Channel is not allowed in Canada, but CNN is. Fair and balanced? You decide.

The USA takes a relentless pounding from many Canadian news organizations and from the liberal government. So, what can we expect from the kids? They're not getting a full picture. And neither is most of the world.

Increasingly, the bully America is being portrayed as the devil. And the far left in this country is gleefully piling on. Guys like Michael Moore [are] running around the world telling everybody what a bad place America is. Moore and his enablers should be very proud of themselves

For the benefit of the Canadian kids, let's take a look at the record:

•The foreign and defense policies of Ronald Reagan (search) resulted in the dissolution of the Soviet Union and the freeing of approximately 122 million people in Eastern Europe.

• The state of Israel would cease to exist if not for American protection, and about 5.5 million Jews would be in grave danger.

• Nearly 23 million Taiwanese would be denied freedom if not for American protection. More than 48 million South Koreans would be living under a dictatorship if not for American protection. USA action led to the removal of the Serbian dictator Milosevic (search), who was responsible for the murders of hundreds of thousands of people in the Balkans.

• The USA and Britain removed the Iraqi dictator Hussein, who was responsible for the murders of hundreds of thousands of people in the Middle East. And we have also removed the terrorist Taliban government in Afghanistan.

• America is sending $15 billion to Africa to help victims of AIDS. We were unable to find out how much France contributes, if anything. To be fair, Canada sends $270 million, which is substantial.

• American action in Central America, Grenada (search), and Haiti (search) has kept millions of people out of totalitarian regimes. Of course, all of this has cost every American taxpayer big. And thousands of American servicepeople have lost their lives protecting people overseas.

It is insulting and dishonest for Americans and Canadians and Europeans to condemn this country because they don't like certain policies. Dissent is good. Slander is unacceptable.

The truth is that the USA has freed more human beings in 230 years than the rest of the world combined. France has freed almost no one. Ditto Canada.

So, pardon me as I object to the Michael Moores of the world — and that man is too cowardly to come in here, all right? Pardon me as I object to the anti-American foreign press and bums like Chirac in France and Chretien in Canada.

America has a provable history of freeing oppressed people all over the world in fighting evil dictators. Canada should be ashamed that so many of its young people are flat out ignorant. And Americans should wise up and realize we are living in a changing world. Old friends are not necessarily true friends.

And that's "The Memo."

The smearing of America continues. That is the subject of this evening's "Talking Points Memo." While the federal government is punishing lewd behavior on the public airwaves, something far worse is going unchallenged by the Feds. Slander, libel, and defamation have now become profit centers with weasels putting out vicious falsehoods and running to the banks with their blood money.

The latest atrocity is a rap song by a guy named Jadakiss, who is just a pitiful pawn being run by the huge Vivendi (search) Corporation, a French company that's distributing some of the most vile entertainment "Talking Points" has ever seen.

Here's Jadakiss's contribution to the Arts:

JADAKISS, RAPPER: Why would n***** push pounds and powder? Why did Bush knock down the towers? Why you around them cowards? Why Aaliyah have to take that flight? Why Halle have to let a white man pop her to get a Oscar? Why Denzel have to be crooked before he took it? Why they didn't make the CL6 with a clutch? And if you don't smoke, why the hell you reachin' for my dutch?

So, according to this smear merchant, President Bush is responsible for murdering 3,000 people and actress Halle Berry (search) won an Academy Award (search) because she had sex with a white man. This is freedom of speech?

So, it's impossible for famous people to sue and win defamation judgments, and the Vivendi Corporation knows it. Thus, slanderers are running wild, saying anything they want, no matter how despicable and getting paid for doing it.

The laws need to be changed. Somebody defames a public figure, that somebody in the corporation behind the smear should be held liable.

Both President Bush and Halle Berry should be able to sue Vivendi and Jadakiss (search) for millions. Enough's enough. You have a movie grossing millions of dollars. It's filled with provable lies. You have best-selling books that defame and injure for no purpose other than profit. You have so-called music that spews hate and encourages criminal activity. And you thought Howard Stern (search) was bad?

The Factor, of course, is boycotting everything Vivendi produces because it's a French corporation, but I urge every responsible American to make sure you're not holding its stock, symbol "V" victor on the New York exchange.

I also urge congress people and senators to draft legislation that would impose fines on companies that distribute provable defamation. That's the only way to bring the smear merchants down because business is good in their evil world, and they'll justify anything and everything.

There's no talking to these people. You got to hit them where it hurts — in the wallet.

And that's "The Memo."

IF you recall the hydrogen bomb tests on bikini, where all the WWII ships were in the bay, the first Hydrogen bomb didnt even capsize most of the ships. They dangled a second Hydrogen bomb some 80 feet below one of the ships to actually sink the fleet. No tsunamis resulted although I believe they were concerned about them.

BILL O'REILLY HOST: Now for the top story tonight, joining us from Washington, Governor Thomas Kean, the chairman of the 9/11 Commission and vice chair Congressman Lee Hamilton.

Again, congratulations, gentlemen. I thought it was an excellent report. I agree with everything you said. Counterterrorism center should be set up. Current position at the CIA should be replaced by a national intelligence director. Sub cabinet — levels, posts — I think you really did an excellent job.

All right, governor, in my analysis, am I making any mistakes or overlooking anything important?

THOMAS KEAN, 9/11 COMMISSION CHAIR: As usual, your analysis is pretty good. I would spend perhaps a little more time on some of the recommendations. We think there are two important jobs we have to do, of course.

One is to tell really the definitive story of 9/11. And I think we did that, bringing some new facts to light.

But secondly, and perhaps more importantly, is looking forward with these recommendations. And the things we learned about 9/11 enabled us to make these recommendations, which we think if we can get them enacted, will simply make the American people safer.

O'REILLY: When I concentrated on the overall global war on terror, including Iraq, I did it for a reason. I took your report, Congressman Hamilton, and I wanted to present it to the American people, because they have to make a very important decision come November.

And there's a lot of slander and defamation and outright lying about the war on terror, which I believe is vitally important. And that's why I think your document, your investigation is so important because it gives Americans some level of truth to counteract the propaganda. Do you see that?

LEE HAMILTON, 9/11 COMMISSION VICE CHAIR : I think it's very important to point out here that we are not investigating, did not investigate the war on Iraq. We investigated 9/11.

In your comments a moment ago, I think you are on the mark. Your language about chaos in the CIA, I think, was a little overstated. But I think there were clearly problems there.

I think you correctly stated how we assessed President Clinton and President Bush's reaction to al Qaeda and Usama bin Laden. Both of them thought he was a threat. Both of them took a number of steps, diplomatic, military, and others. None of them were successful. But they were genuinely concerned about that threat.

But they did not perceive, as indeed the American people did not perceive, the gravity of the threat in the sense that we could lose 3,000 lives in an hour's time.

But I want to be very clear that our statement with regard to Iraq — the contacts which you mentioned between Iraq and al Qaeda and Usama bin Laden, we think they occurred. We do not think there was a cooperative, collaborative relationship...

O'REILLY: Yes, and I see that.

HAMILTON: ...with regard to the — that's right. With regard to...

O'REILLY: And that's clear, but...

HAMILTON: With regard to 9/11.

O'REILLY: Congressman Hamilton, I want to ask you a very direct question. You put yourself in the position of the president of the United States, all right, right after 9/11 happened. You're being told WMDs are in Iraq, all right, by the Russian intelligence, British intelligence and your own CIA

You know — because you guys found this out, that Saddam had a relationship with bin Laden. Clearly the president of the United States shouldn't — couldn't just let Saddam Hussein sit there. And that's the point I was trying to make, sir.

HAMILTON: I understand that, but you're drawing me into waters I don't want to go into.

O'REILLY: I know you don't. That's what we do here. How about you, Governor Kean? You want to weigh in on that?

KEAN: Not really, because that isn't the main subject of our report.

O'REILLY: I know, but it's important for the nation, you see? Because this — they've taken the terrorism thing — you guys know this — because you saw it in your own — and one of the good things about your report is unlike the hearings, you stripped away all of the partisan b.s. in the report. And I admire that. But you know that your report is going to be used for political reasons. And that's why I'm bringing this up.

KEAN: Well, you know something? I think the American people at this point — on this subject and the subject of protecting themselves from terrorists, I think the candidates who try to spin this for political reasons are taking a risk. Because I really think — I mean, we had just a news conference with a number of Republicans and Democrats led by McCain, and Lieberman, a bunch of people in the House.

We got wonderful comments from President Bush, good comments from Senator Kerry. There seems to be, at least in my mind, and maybe I'm naive, but some sort of a bipartisan consensus forming around this issue of protecting a nation against terror. And I think this is what the American people want. I think those politicians who choose to spin this and polarize it and to partisanize it are going to get themselves in some trouble.

O'REILLY: OK, well that's very interesting. And I agree. I don't think anybody can oppose this report. But I do know they're going over it and trying to point out things that'll help.

KEAN: We had an interesting thing, by the way. When we got into a discussion on the commission, and we started to really disagree on some things, we had a mantra. And it's let go back to the facts.

O'REILLY: Right.

KEAN: We have to agree on the facts.

O'REILLY: And that's why this report is fascinating, because it is factually based.

Now Congressman Hamilton — you and Governor Kean are patriots, by the way. And I can't tell you how much I admire you both. And I hope the audience knows that. You're patriots. You did this, you were called out of your other lives to do this. And you did an excellent job.

You, sir, Congressman Hamilton, what is the one thing, the most important thing you took away — and I'm going ask you the same question, governor? The one thing? Most important thing?

HAMILTON: Well, the most important thing by far is the manner in which the American people responded to 9/11. Tragedy of untold proportions. We listened to testimony that would rip your heart out. And yet if you see the resilience and the strength of the American people in responding to that, it's really a very inspiring story. And that story continues. It doesn't cut off...

O'REILLY: OK.

HAMILTON: ...in a few weeks after 9/11.

O'REILLY: How about you, governor, the most important thing you took away? 30 seconds, sir?

KEAN: How unprepared, really, we were, for what happened. Starting with Blackhawk down — these people were trying to kill Americans. They killed a number of Americans along the way incident after incident after incident. We knew they had the capability to do so. We knew they were threatening citizens in the United States, whether military or civilian. And yet, nobody put it together, either for the president of the United States, the Congress, or for the American people.

O'REILLY: Well, some of the guys did, but they couldn't get it through.

KEAN: Very few, very few.

O'REILLY: Right, the FBI guy in New York.

KEAN: Yes, that's correct.

O'REILLY: Gentlemen, thanks very much. We really appreciate it. And I recommend everybody read this report. It's excellent.
