If Elected, Kerry Could Get Upto 4 Justices On the Supreme Court
7-22-04 | ComtedeMaistre

While President Bush has been able to do a number of good things as President, the most tragic aspect of his presidency, is that he has not been able to appoint a Justice to the Supreme Court.

I was sincerely hoping that Stevens, Rehnquist and O'Connor would retire, as was widely speculated in the media, which would allow Bush to appoint conservative justices in their 40s and early 50s, who would influence the court for the next generation. These justices would have the same influence on the court that Justice Rehnquist has had over the past 30 years. Unfortunately, Bush is likely to serve out his first term, without making judicial appointments to the high court.

If Kerry was to win in November, and get to serve two terms, he may make as many as 4 appointments to the Supreme Court. Rehnquist cannot hold on for another 8 years, so Kerry may name his replacement. Stevens will retire happily if Kerry is elected, perhaps a few days after Kerry's inauguration. O'Connor is also likely to leave over the next 8 years. And Justice Ginsburg, with her cancer, will be glad to retire on health grounds and have Kerry pick her replacement.

Those are the stakes in the November election.

As Harry Reid was fond of saying, "If it was good enough for the 108th Congress, it's good enough for the 109th Congress."

Why? The Dems have established that it takes at least 60 senate votes to confirm a judge. The Dems are not going to win an additional 12 seats this year.

You can expect the New England Republican Senators and Arlen Spector, to team up with a few other wishy-washy Republicans from the Midwest, to come up with 60 votes to beat a Senate filibuster.

A single Senator can assert his will, unless 60 Senators object to the assertion. IMO, the people have lost control of their government.

This scares me as much as anything and ought to scare 90% of all Americans. The court has some awful "justices" now and more Souters or Ginnsbergs will take our freedom away --and use our taxes for even more absurd uses. We just have to vote President Bush and a Republican Senate and Congress--if we don't, our failure as a country is assured.

>>>I think Scalia might retire as well in disgust, realizing the modern Constitution will be as shredded as Ollie North's Iran-Contra papers.<<<

I have heard rumours of Scalia wanting to retire, and go into the private sector. It was expected that Bush would appoint him Chief Justice, following Rehnquist's retirement, in order to persuade him to stay.

You are absolutely correct, in that Scalia, who is a very passionate man, will quit in disgust if Kerry wins and appoints leftist judges.

That will leave Justice Thomas as the lone conservative, facing down 8 socialists in black robes. Thomas already has a hard time now, given the trashing he has received from the black communinity and the liberal media. If he is outnumbered 8-1, without Scalia for company, he may finally crack under combined pressure from blacks and liberals.

I think the question you meant to ask was: Had Specter voted against any of Clinton's nominees in Committee?

Everyone else has already stated this but I will repeat it anyway.

The reps will hike their skirts, pull down their panties and bend over for the dems. If the reps cant get semi conservative judges appointed to smaller courts they wont stand a chance with the supreme court. The media will tell the sheeple what to think and the reps will see to it that the will of the dems is carried out.

This is the main reason why I think we are really dealing with one party. Many people can come up with the reasons for stating that there is a difference but the reps seldom act like it.

In the past few years we have seen reps sponser legislation that dems would never get passed and dems sponser stuff that reps would be villified for. Witness the way hillarys husband pretty much ran the country as a moderate even leaning slightly right. President Bush tosses conservatives a bone now and then but If he had a fighting spirit he would use the soapbox as his main weapon and he would FIGHT big time for what is right especially with a majority in both houses.

You may also have meant to ask: Which Republican played a key role in defeating conservative Supreme Court justice nominee Robert Bork in 1987? (hint: rhymes with spectre)

Touche. She flew right through...after serving for one of the most controversial left-leaning organizations in the country. It would be like Bush appointing the in-house counsel from Weekly Standard.

Yep.... but he was also the attack dog in the Thomas Clarence hearing.... you win some you lose some.

Again how many Bush nominees has he voted against in committee?

Oh my gawd! Four more Ruth Bader Ginsburgs! The difference between Pubbies and Dims in the Senate: the Pubbies rolled over and confirmed that witch for the Supreme Court while the Dims filibuster Appeals Court nominees not to their ideological liking. Sometimes I think our Republic is doomed.

If Kerry is elected and the socialist win or come close in the Congress, you can kiss this country goodbye. The damage he does will not be corrected in 25 years. He will cause so many spending freebies to the unwashed that you can kiss 50% of your paycheck good bye!

Ever get the feeling the Republicans are trying to make that happen?

I firmly believe that the center of gravity in idealogy has shifted significantly to the LEFT. Republicans are for the most part liberals, with a few conservatives like Santorum, Nickles and Inhofe in the entire Senate. Democrats are for the most part Socialists with a few Liberals like Lieberman. The only Democrat in the entire Senate that is conservative is Zell Miller.

Conservatism left when Ronald Reagan and Maggie Thatcher departed the political scene and I don't see it coming back any time soon.

None of them, but who cares in this scenario? Bush wouldn't be making any nominations if Kerry gets elected president. Specter did say he would probably vote against Pryor if there were a vote on the full Senate floor.

Did you know that Specter has always supported sending nominees for a floor vote even if he opposed them? That included Robert Bork..
